A driver who crashed his truck into a railroad crossing arm on Sunday failed field sobriety testing then tested at .131 BAC on a chemical test.

Chad Dewayne Johnson, 38, Linton, was arrested by Deputy Jordan Allor of the Greene County Sheriff’s Department on Sunday, May 24.

Deputy Allor was dispatched around 7:40 p.m. to the scene of a crash at the intersection of North State Road 59 and County Road 300 North where a black 2008 Chevrolet Silverado had lost control on wet pavement and hit a railroad crossing arm.

Johnson was the driver and he had one female passenger on board.

When Johnson was asked if he’d been drinking alcohol, he said one beer. When faced with taking field sobriety tests, Johnson allegedly said he knew he was going to flunk, and he did.

Deputy Allor said that during the stop, Johnson was upset because he was on probation and he was yelling at his passenger that this was all her fault and he was never going to talk to her again.

Johnson was transported to the Linton Police Department for a chemical test. The results showed he had an alcohol concentration of .131. The legal limit is .08. Johnson also has a previous conviction for operating a vehicle while intoxicated.

He was booked into the Greene County Jail at 9:26 p.m. His bond was set at $8,000 surety with ten percent cash allowed. He posted $800 and was released on May 25. His initial hearing is scheduled for June 11.

Johnson is facing preliminary charges of:

• Operating a vehicle while intoxicated endanger a person, a Class A misdemeanor,

• Operating a vehicle while intoxicated endangering a person with a prior within seven years, a Level 6 felony,

• Operating a vehicle while intoxicated, a Class C misdemeanor,

• Operating a vehicle while intoxicated with a prior conviction within seven years, a Level 6 felony,

• Operating a vehicle with an alcohol concentration equivalent to at least .08 but less than .15, a Class C misdemeanor, and

• Operating a vehicle with an alcohol concentration equivalent of .08 or more with a prior conviction, a Level 6 felony.
