Criminal charges of OVWI filed after test results showed driver had BAC of .253
/After blood test results came back, a criminal case was filed this week against a driver who crashed his car into a guardrail in the Springville area last September then was transported to the hospital with injuries to his legs.
Johnathon Eric Mofield, 36, Bloomington, will be receiving his summons to appear in Greene Superior Court at 8:30 AM on February 9 for an initial hearing on charges of:
Operating a vehicle while intoxicated endangering a person, a Class A misdemeanor,
Operating a vehicle while intoxicated, a Class C misdemeanor, and
Operating a vehicle with an alcohol concentration equivalent to .15 or more, a Class A misdemeanor.
Deputy Caleb Sipes, the investigating officer, and Deputy Harvey Holt, both from the Greene County Sheriff's Department, were dispatched to the scene of a crash on East State Road 54 in the Springville area around 5:30 PM on September 11, 2022.
First responders were already on the scene when the deputies arrived and saw a red 2015 Ford Focus with severe front-end damage from striking a guardrail. The driver, later identified as Mofield, was sitting in a chair alongside the highway talking to emergency medical personnel. Deputy Sipes said he could smell the odor of an alcoholic beverage coming from the breath of Mofield who was injured in the crash and transported to IU Health Bloomington Hospital by the Greene County Ambulance Service followed by Deputy Holt.
A blood draw was taken at the hospital and sent to the Indiana Department of Toxicology for analysis.
Mofield agreed to talk about what happened with Deputy Holt who reported Mofield admitted he started drinking at 10:30 that morning and drank 10-12 Natural Ice beers and a fifth of whiskey prior to the crash. Standard field sobriety testing was not an option as Mofield was receiving medical treatment for injuries to his legs.
While they were at the hospital, Deputy Sipes was working the scene and talked to a firefighter who was cleaning off the roadway. According to Deputy Sipes, the firefighter said Mofield was the only person in the vehicle and that Mofield told him he had been fighting with his wife earlier and had drank at least a 12 pack. Deputy Sipes noted there was a purple drinking container inside Mofield’s vehicle that smelled like alcohol and there was a box of Natural Ice beer in the passenger floorboard with two open beer cans.
On January 10, GCSD received the results from the Indiana State Department of Toxicology which showed Mofield had a blood alcohol concentration of .253. The legal limit is .08.
The Greene County Prosecutors Office filed the criminal case against Mofield this week and he will be receiving his summons in the mail.
