Arrested for OVWI then didn't follow the rules

Driving left of center, then overcorrecting almost hitting a curb was the cause for a traffic stop that resulted in the July 28 arrest of a 26-year-old Bloomington man in Bloomfield.

JOSHUA DAVID BLACK

Greene County Sheriff’s Department Deputy Cody Loncaric was driving on Main Street in Bloomfield when he observed a Ford F150 truck travel left of the center line and overcorrect almost striking the right-side curb. The vehicle then corrected back to the left to avoid colliding with a parked vehicle. Loncaric noted when he passed by the parked car, there appeared to be an individual in the passenger seat. The driver, later identified as Joshua David Black, initiated his turn signal at the last moment, less than 200 feet, before turning onto South Judge Street. When he turned into a gravel lot across from Farmers and Mechanics Federal, Loncaric initiated a traffic stop.

Black exited his vehicle and began walking toward Deputy Loncaric. Loncaric informed Black of the reason for the stop to which Black explained he was heading to the Spot Lounge to meet a few friends. He told the officer he had previously been at the Feed Store Beer Co. and consumed two alcoholic beverages there. Bloomfield Police Department Lieutenant Marvin Holt arrived on the scene and Black confirmed he had consumed two beverages before heading to the Spot Lounge.

Black failed a standard field sobriety test and refused a portable breath test. He also refused a certified chemical test. Black was transported to Greene County Jail.

While Deputy Loncaric applied for a warrant to obtain the blood draw, he was contacted by Corporal Steve Dobson, an officer at the Greene County Jail, who said he has just taken Black to use the restroom. While in the restroom, Black was attempting to get a drink of water from the bathroom sink as he was washing his hands. Due to the investigation, Black was not allowed to have drinks at the time.

Cpl. Dobson said he told Black to stop drinking water but he refused. He pulled him away from the sink, but Black pulled back towards to sink several times while being restrained.

Black’s bond was set at $5,000 surety with 10 percent cash allowed.

He was charged with:

  • Operating a vehicle while intoxicated endangering a person, a Class A Misdemeanor

  • Resisting Law Enforcement, a Class A Misdemeanor
