An incident of gunfire in Linton last May resulted in the arrest of two individuals who were charged with intimidation and criminal recklessness with a deadly weapon. When one appeared in court yesterday, he admitted guilt and was sentenced to two years with all but 300 days suspended.

Bradon M. Graham, 18 at the time of the incident, now 19 years old, was arrested by Det. James O’Malley of the Greene County Sheriff’s Department on Thursday, May 24.

Graham was then charged with:

Intimidation – defendant draws or uses a deadly weapon, a Level 5 felony,
Criminal recklessness committed with a deadly weapon, a Level 6 felony, and
Pointing a firearm at another person, a Level 6 felony.

By early October, a negotiated plea agreement was reached and signed by Graham, Greene County Prosecutor Jarrod Holtsclaw and Greene County Deputy Public Defender Ellen Martin who was appointed to represent Graham.

A change of plea and sentencing hearing was scheduled for the end of October but during the hearing, the negotiated plea agreement was rejected by the court.

In mid-March, another agreement was filed.

After Greene County Community Corrections prepared a work release evaluation, a change of plea and sentencing hearing was conducted yesterday, Wednesday, April 10, in Greene Circuit Court.

Appearing before Judge Eric Allen, Graham pleaded guilty to the second count of criminal recklessness, a Level 6 felony. Under the terms of the plea agreement, accepted by the court, the first count of intimidation and the third count of pointing a firearm were both dismissed. Also in the agreement, the sentence was fixed and the court was bound by the terms.

Graham was sentenced to two years in the Greene County Jail with all but 300 days suspended. He was given credit for eight days already served. Graham will serve the first 90 days of his time incarcerated and serve the rest in the Greene County Community Corrections Work Release Program as long as he remains eligible.

After his time is served, he will be on supervised probation for one and one-half years.
