Mississippi man arrested on OWI charges after crash near Linton
/A Mississippi man was arrested early Saturday after authorities say he crashed his pickup truck off State Road 59 near Linton and showed signs of intoxication while refusing to cooperate with deputies.
David Julien Duplantis, 27, of Magnolia, Mississippi, was arrested at 1:27 a.m. June 28 on preliminary charges of operating a vehicle while intoxicated-endangerment, a Class A misdemeanor, and operating a vehicle while intoxicated, a Class C misdemeanor. He was held on a surety-only bond.
According to a probable cause affidavit, deputies with the Greene County Sheriff's Office were dispatched at approximately 11:39 p.m. June 27 after a caller reported hearing a crash and a vehicle horn continuously sounding near the 1500 block of South State Road 59. When deputies arrived, they found a gray 2012 Ford F-250 off the east side of the roadway in a tree line.
Linton Police Department Officer Bracey Breneman advised that Duplantis refused to discuss the crash while remaining on his cellphone but did provide his driver's license. Breneman also reported seeing alcoholic beverage containers inside the truck.
Greene County Sheriff’s Department Sgt. Jordan Allor reported Duplantis repeatedly ignored commands to end his phone call and speak with investigators. According to the affidavit, he remained on the phone for approximately two and a half minutes despite being told multiple times to cooperate. When warned he would be detained if he continued refusing, Allor said Duplantis smirked and shook his head before being placed in handcuffs.
While speaking with Duplantis, deputies reported smelling the odor of an alcoholic beverage on his breath and observing that his eyes were red and glassy. During standardized field sobriety testing, officers documented signs of impairment, including clues during the horizontal gaze nystagmus test. The affidavit states Duplantis interrupted the test, claiming it was being administered incorrectly.
Investigators said Duplantis refused both a preliminary breath test and a chemical blood test after being read Indiana's implied consent law. Deputies then obtained a search warrant for a blood draw, which was executed at Greene County General Hospital at approximately 1:03 a.m. June 28. After receiving medical clearance and completing the blood draw, Duplantis was transported to the Greene County Jail.
Court records indicate Duplantis was booked on the preliminary charges of operating a vehicle while intoxicated-endangerment and operating a vehicle while intoxicated.
