Linton woman arrested on drug and alcohol-related charges
/A 44-year-old Linton woman appeared in Greene Superior Court on Nov. 13 for an initial hearing on several drug and alcohol-related charges stemming from a Nov. 4 incident.
Greene County Sheriff’s Department Deputy Andrew Shelton arrested Brandy Jean Wilkes in the early morning hours of Nov. 4 on charges of possession of methamphetamine, obstruction of justice, operating a vehicle while intoxicated endangering a person, operating a vehicle while intoxicated – first offense and no endangerment, operating a vehicle with a Schedule I or II controlled substance or its metabolite in the blood, and possession of marijuana.
Deputy Shelton performed a traffic stop on a vehicle, driven by Wilkes, after the vehicle turned into the opposite lane of State Road 54 West. According to the probable cause affidavit, there was no oncoming traffic at the time. When asked to provide her license and registration, Deputy Shelton wrote in the probable cause affidavit that Wilkes gave him her license but scrolled through her vehicle manual. Eventually, he was able to obtain the vehicle registration. Wilkes alleged she swerved into the wrong lane due to dropping something on the floorboard.
Deputy Shelton’s field training officer Deputy Camron Frye approached the vehicle and according to the probable cause affidavit had reason to believe Wilkes was operating under the influence. The officers informed Wilkes they believed she was operating under the influence and obtained permission to search the vehicle. While speaking with Wilkes, Greene County Sheriff’s Department Sgt. Jordan Allor asked if she had marijuana on her as an odor of the drug could be detected. Wilkes alleged she did smoke marijuana but had not partook of the drug that day. She alleged she did not believe there was any marijuana in the vehicle.
A partially smoked hand-rolled cigarette with green plant-like material inside was located inside Wilkes's sweatshirt pocket. Also located was another partially smoked cigarette as well as a fully intact one – both hand-rolled with green plant-like material inside. The material inside, according to the probable cause affidavit, later field-tested positive for marijuana.
Wilkes consented to and failed a standardized field sobriety test. According to the probable cause, Wilkes was informed a search warrant for a blood sample would be sought. The search warrant was granted and a blood sample was taken at the Greene County Sheriff’s Department, results pending.
While Wilkes was in an interview room at the Greene County Jail, Deputies Shelton and Frye returned to the squad car she was transported in. Located in the front passenger seat where Wilkes had been sitting were two clear plastic bags containing a white crystal-like substance. According to the probable cause affidavit, the substance later field-tested positive for methamphetamine.
At the time of her arrest, she was held without bond; however, a bond amount of $10,000 surety with 10% cash allowed was set at her initial hearing on Nov. 13.
Wilkes is facing charges of:
Possession of methamphetamine, a Level 6 Felony
Obstruction of justice, a Level 6 Felony
Operating a vehicle while intoxicated endangering a person, a Class A Misdemeanor
Operating a vehicle while intoxicated – first offense and no endangerment, a Class C Misdemeanor
Operating a vehicle with a Schedule I or II controlled substance or its metabolite in the blood, a Class C Misdemeanor
Possession of marijuana, a Class B Misdemeanor
