Deputy reported driver had BAC of .213

After a woman got into an argument with her boyfriend and left their house in his truck, she was stopped by a GCSD deputy who arrested her on OVWI charges.

Abby Rae Mulry, 36, Springville, was arrested by Deputy Sergeant Jordan Allor of the Greene County Sheriff's Department late Sunday, March 26.

Around 10:08 that night a man called the sheriff's department and told the dispatcher that his live-in girlfriend, Abby Mulry, had battered him multiple times over the previous two days and he had asked her to leave but she was refusing to leave their residence on East State Road 54 in the Springville area.

Deputy Sergeant Allor was dispatched and on the way there, the man called again and told the dispatcher that Mulry had left the residence in his black Chevrolet Silverado and was driving recklessly on East Hobbieville Road.

When Allor arrived in the area of E SR 54 and East Hobbieville Road, he spotted a vehicle he thought was a black Chevrolet Silverado. As he turned around, the vehicle accelerated away from him then disregarded a stop sign and drove into a driveway on East SR 54 then continued up the driveway at a high rate of speed, driving through grass at times.

Mulry was the driver who parked in front of the garage and turned the lights off. Allor turned his emergency red and blue lights on and told Mulry to get out of the vehicle and walk back toward him. Allor reported she had a dazed expression and unsteady balance, had a hard time forming sentences and had the odor of an alcoholic beverage coming from her breath.

When asked what happened that night with her boyfriend, she allegedly said they were just arguing and she did not hit him. She allegedly admitted she had consumed four beers and was transported to the sheriff's department for sobriety testing. She passed one portion of the test and failed all the rest then agreed to take a chemical test. Allor reported it showed she had an alcohol concentration of .213. The legal limit is .08.

Mulry was booked into the Greene County Jail at 11:43 PM with bond set at $4000 surety with 10% cash allowed. She has since posted bond and been released.

A criminal case was filed against her in Greene Superior Court with her initial hearing set for April 4, but Mulry retained a defense attorney who asked for a waiver of the initial hearing.

Mulry has now been charged with:

  • Operating a vehicle while intoxicated endangering a person, a Class A misdemeanor,

  • Operating a vehicle while intoxicated - first offense and no endangerment, a Class C misdemeanor, and

  • Operating a vehicle with an alcohol concentration equivalent to .15 or more, a class A misdemeanor.
