Speeder on I-69 refuses test to measure blood alcohol concentration
/A trooper running radar on I-69 last Friday reported he clocked a 2019 Toyota Corolla going 90 mph, then could smell alcohol coming from inside the vehicle during the traffic stop. The driver wound up in the Greene County Jail.
Zachary Alan Naish, 26, of Fort Campbell, Ky., was arrested by Indiana State Police Master Trooper John Yung and booked into the Greene County Jail a little after 5 p.m. on Friday, March 22.
The driver, identified as Naish, allegedly said he got off work around midnight and had been drinking until around 2 a.m. But when tested on a portable “Alco-Sensor” at 12:42 p.m., Trooper Yung said he tested at .22 BAC. The legal limit is .08.
Naish allegedly failed field sobriety testing on the scene and was then transported to the sheriff’s department where he also failed testing and refused to take a chemical test.
Yung obtained a search warrant to draw a blood sample but after being transported to Greene County General Hospital for a blood draw, Naish refused to allow the phlebotomist to draw a sample even though Naish was informed that if he refused, he could be incarcerated for 90 days with no good time credit.
The preliminary charges filed against Naish include:
Operating a vehicle while intoxicated endangering a person, a Class A misdemeanor
Operating a vehicle while intoxicated, a Class C misdemeanor, and
Obstruction of justice – knowingly or intentionally induces by threat, a Level 6 felony.
He is scheduled to appear in Greene Superior Court for an initial hearing on April 8.
