Driver found unconscious at Switz City intersection faces multiple OWI charges

A 28-year-old Switz City man was arrested early Feb. 19 after deputies found him unconscious behind the wheel of a running vehicle at an intersection, according to court documents.

Danny Miller was taken into custody following the incident at the intersection of Charlotte Avenue and State Road 54.

He is charged with multiple counts related to operating a vehicle while intoxicated, including: operating a vehicle while intoxicated endangering a person, a Class A misdemeanor; operating a vehicle while intoxicated endangering a person with a prior conviction within seven years, a Level 6 felony; operating a vehicle while intoxicated, a Class C misdemeanor; and operating a vehicle while intoxicated with a prior conviction within seven years, a Level 6 felony.

According to a probable cause affidavit filed by Greene County Sheriff’s Deputy Brayden DeMier, deputies responded to a report of a male driver unconscious inside a gray 2015 Chevrolet Equinox.

Upon arrival, firefighters were reportedly knocking on the driver’s side window. The vehicle was running, in drive, and emitting smoke from the engine compartment, creating what officials described as an immediate safety risk. Miller was seated in the driver’s seat with his foot on the brake and was initially unresponsive.

Deputies said Miller eventually began moving but appeared disoriented and had difficulty unlocking the door when instructed to do so. After the door was opened, a deputy shifted the vehicle into park before Miller exited. Court documents state Miller had poor balance as he stepped away from the vehicle.

Deputies reported observing signs of impairment, including bloodshot eyes, confusion and a strong odor of alcohol. The vehicle was also positioned in the incorrect lane of travel, according to the affidavit.

When questioned, Miller told deputies he had been at a friend’s house nearby and had consumed alcohol but described the amount as “not a whole lot,” according to court records. He declined to perform field sobriety tests and later requested an attorney. Deputies said Miller also refused to consent to a chemical test under Indiana’s implied consent law.

A search warrant for a blood draw was later granted by Judge Dena Martin. The warrant was executed at the Greene County Jail, where Miller was transported and booked.

He is scheduled to appear in Greene Superior Court for an initial hearing on March 2.
