Vehicle upside down in ditch leads to OVWI charges
/A Jasonville driver who ran off the road and ended up upside down in a ditch earlier this month was not seriously injured but he is facing charges of OVWI.
Bradley G. Dyer, 52, Jasonville, was arrested by Deputy Michael Coy of the Greene County Sheriff's Department on Tuesday night, December 6.
Deputy Coy was dispatched around 7:17 PM to a crash on West Terre Haute Road near County Road 800 North after a woman called the sheriff's department and reported a PT Cruiser was in the ditch on its top. She said a man was getting out of the vehicle.
When Deputy Coy arrived on the scene at 7:30 PM, WPD Officer Sparks was already there and Coy saw the driver standing next to the overturned vehicle in the ditch.
Dyer was the driver who said he thought his only injury was an abrasion to the top of his head and that he hit his brakes to avoid a collision with something which caused him to run off the road. Dyer was treated by ambulance personnel on the scene but then Deputy Milligan arrived around 9:36 PM and said she smelled the odor of alcohol coming from Dyer.
Dyer agreed to take a portable breathalyzer test which showed BAC of .165. Deputy Coy said due to the rural nature of the location and the weather, he transported Dyer to the sheriff's department to conduct testing in a safe climate-controlled environment. On the way to the sheriff's department, Dyer allegedly said something ran across the road and he hit the brakes, then the vehicle began to slide and he hit the ditch.
Once at the sheriff's department, Dyer passed one portion of field sobriety testing but failed others. He agreed to take a chemical test which indicated he had a blood alcohol concentration of .143. The legal limit is .08.
Dyer was booked into the Greene County Jail at 9:30 PM with bond set at $4000 surety with 10% cash allowed. He has since posted $400 bond and been released.
Dyer is scheduled to appear in Greene Superior Court for his initial hearing on December 19 when he will be formally charged with:
Operating a vehicle while intoxicated endangering a person, a Class A misdemeanor,
Operating a vehicle while intoxicated, a Class C misdemeanor, and
Operating a vehicle with an alcohol concentration equivalent to at least .08 but less than .15, a Class C misdemeanor.
