Linton man arrested for OWI following traffic stop
/A Linton man was arrested Wednesday evening after allegedly running a red light and showing signs of intoxication during a traffic stop on State Road 54.
According to a report from the Linton Police Department, Patrolman Cade Herndon responded to assist Lt. Jerrad Pirtle, who had initiated a traffic stop just east of Arby’s around 5:21 p.m. on July 9. Pirtle reported that the driver, later identified as John Murley, 33, had failed to stop at the red light near the shopping center and that he detected the odor of alcohol coming from the vehicle.
Murley was asked to exit the vehicle, and Herndon administered a series of standardized field sobriety tests. Murley reportedly showed signs of impairment while completing the sobriety tests.
When asked to provide a sample on a portable breath test (PBT), Murley initially questioned the consequences of refusing, later admitting he had consumed two Twisted Teas and had stopped drinking about 45 minutes prior to the stop. He then submitted to the PBT, which showed a blood alcohol content (BAC) of 0.098%.
Murley was taken into custody and transported to the Linton Police Department, where a certified breath test was administered by Deputy Travis Hasler of the Greene County Sheriff’s Department. The test, completed after the required observation period, indicated a BAC of 0.106%.
Murley was then transported to the Greene County Jail by Deputy Sipes. His bond was set at $4,000 surety with 10% cash allowed. He was released after posting $400.
Murley faces charges of operating a vehicle while intoxicated, a Class C Misdemeanor; operating a vehicle while intoxicated endangering a person, a Class A Misdemeanor; and operating a vehicle with an alcohol concentration equivalent to at least .08 but less than .15, a Class C Misdemeanor.
