Linton man accused of residential entry, battery after alleged altercation

A 29-year-old Linton man was arrested June 6 after police allege he entered a residence without permission, assaulted multiple individuals, and damaged a police vehicle during his arrest.

Austin Dean Holmes faces preliminary charges of residential entry, a Level 6 felony; criminal mischief resulting in damage between $750 and $50,000, a Class A misdemeanor; criminal mischief, a Class B misdemeanor; two counts of battery, Class B misdemeanors; and battery by bodily waste, a Class B misdemeanor.

According to a probable cause affidavit filed by Officer Andrew Mifflin of the Linton Police Department, officers were initially dispatched to a residence on A Street Northeast at approximately 9:20 a.m. June 6 for a report of property damage.

A woman told police Holmes had allegedly smashed her iPhone 13 during an argument, rendering it unusable. Another witness reportedly told officers she had video of the incident and later uploaded the footage to the department's evidence system.

Police also learned Holmes was allegedly in possession of the woman's car keys. Officers later located Holmes, recovered the keys, then informed him he was no longer permitted on the property.

Less than an hour later, police were dispatched to a reported fight in progress nearby.

According to court documents, witnesses told investigators that Holmes entered a residence on Northeast F Street without permission. Witnesses alleged an argument quickly escalated, and Holmes shoved an elderly man to the ground after entering the home.

The man, who police described as wheelchair-bound and having difficulty standing, declined medical treatment but reported pain in his legs following the fall.

Another witness told police he heard the confrontation and observed Holmes standing over the elderly man after he fell. The witness said he intervened to remove Holmes from the residence, leading to a physical altercation.

Investigators also reported that Holmes spit blood on another individual during the incident.

While officers were interviewing witnesses, Holmes reportedly returned to the area and approached the residence aggressively. Police said he ignored commands before eventually complying after an officer drew a Taser.

According to the affidavit, Holmes then threatened several individuals gathered outside, telling them, "You all got it coming."

After being placed in a patrol vehicle, Holmes allegedly attempted to climb out through a rear window despite being restrained. Officers added additional restraints and secured the vehicle.

Police said Holmes later kicked out a rear patrol car window and damaged the door frame, causing damage believed to exceed $750.

Court documents further allege Holmes continued making threats toward individuals involved in the incident while officers were on scene.

Holmes was transported to Greene County General Hospital for medical clearance before being booked into the Greene County Jail.
