Justin Dale Leon Franklin, 22, formerly of Solsberry, who currently has a home address in Fishers but was serving out a sentence at the Greene County Community Corrections work release center, was taken into custody on Monday afternoon, April 15, by Indiana State Police Trooper Richard Klun.

Earlier that afternoon, officials at Community Corrections had requested Trooper Klun to come to the center with his K9 Loki to perform a sniff around the exterior of Franklin’s vehicle. They said they suspected Franklin of possession of illegal contraband in his vehicle.

When Trooper Klun deployed K-9 Loki, Loki gave alerts to the presence of odors he is trained to detect.

A subsequent search of the vehicle by Klun, with Community Corrections personnel present, yielded substances that field tested positive for the presence of more than one controlled substance.

Trooper Klun then talked to Franklin and reported that as he was explaining what had been located, when he mentioned material that appeared to be marijuana, Franklin said, “Yeah, I knew about that.” Franklin was then taken into custody and transported to the jail.

The next day, Tuesday, April 16, Chief Deputy Prosecutor Keven McIntosh filed a new criminal case against Franklin and on Thursday morning, Franklin appeared in Greene Superior Court for an initial hearing.

During the hearing, Deputy Public Defender Ellen Martin was appointed to represent Franklin who was formally charged with:

  • Possession of methamphetamine, a Level 6 felony,

  • Possession of cocaine, a Level 6 felony, and

  • Possession of marijuana, a Class B misdemeanor.

Also during the hearing, Judge Dena Martin ordered Franklin’s bond be set at $50,000 cash only, in full, with no ten percent allowed.
