Sulllivan man arrested on felony OWI charges following traffic stop in Linton

A Sullivan man was arrested in the early morning hours of June 14 after a traffic stop in Linton led to an investigation for operating a vehicle while intoxicated.

According to a probable cause affidavit, Linton Police Officer Jocelyn Astleford observed a Jeep Grand Cherokee fail to use a turn signal while turning into the Taco Bell parking lot on State Road 54 at approximately 11:09 p.m. June 14.

During the traffic stop, the driver, identified as Jeremy Daniel Waggoner, 48, of Sullivan, allegedly exhibited signs of impairment, including the odor of an alcoholic beverage and slurred speech. Court documents state Waggoner admitted to consuming three beers within the previous hour and a half.

Police conducted standardized field sobriety tests and reported observing multiple indicators of impairment. Waggoner declined a portable breath test but agreed to a certified chemical breath test after being read Indiana's implied consent warning.

According to the affidavit, a chemical breath test administered at the Linton Police Department produced a result of 0.147 grams of alcohol per 210 liters of breath, nearly twice Indiana's legal limit of 0.08.

Investigators also determined Waggoner had a prior operating while intoxicated conviction from 2021 in Sullivan County.

According to court records, Waggoner faces the following charges:

  • Operating a Vehicle While Intoxicated, a Class C misdemeanor

  • Operating a Vehicle While Intoxicated with a Prior Conviction Within Seven Years, a Level 6 felony

  • Operating a Vehicle with an Alcohol Concentration Equivalent (ACE) of .08 or More, a Class C misdemeanor

  • Operating a Vehicle with an ACE of .08 or More with a Prior Conviction, a Level 6 felony

His bond was set at $8,000 surety with 10% cash allowed.
