Martinsville woman arrested for DUI; child found in vehicle
/A Martinsville woman was arrested Tuesday evening after police say she was driving recklessly through Linton with a child in her vehicle and later registered a blood-alcohol level more than three times the legal limit.
According to a report from the Linton Police Department Patrolman Cade Herndon was dispatched on Nov. 17 to a call about a reckless driver heading west into Linton on State Road 54 from Switz City. The reporting caller described a black Ford Fusion swerving on the roadway.
Herndon located the vehicle near Shoe Show and observed it swerving left and right, with the car behind it flashing headlights to warn other drivers. He initiated a traffic stop in the Long John Silver’s parking lot.
The driver—identified as Alexus Kay Lynn Smithes, 33, of Martinsville—was looking at her phone when Herndon approached her window. The officer reported that Smithes was slurring her speech, smelled strongly of alcohol, and was unsteady on her feet after exiting the vehicle. During a pat-down, Smithes removed a small bottle of liquor from her jacket and stated that she had her child in the vehicle.
Herndon conducted standardized field sobriety tests, noting multiple signs of impairment. Due to the level of impairment, testing wasn’t fully completed.
Smithes consented to a portable breath test, which showed a 0.26 BAC, more than triple the legal limit. She told the officer she had consumed “a shot on the drive from Martinsville.”
The Department of Child Services was notified, and Smithes contacted someone to pick up her child.
Smithes was transported to Greene County General Hospital for a blood draw and medical clearance before being taken to the Greene County Jail. Results of the blood draw are pending.
According to jail booking information, Smithes was booked into the jail at 7:31 p.m. on preliminary charges of operating a vehicle while intoxicated; operating a vehicle while intoxicated–endangerment; operating a vehicle with an alcohol concentration equivalent of at least .15 percent; and operating a vehicle while intoxicated with a prior conviction. Her bond was set at $8,000 surety with 10% cash allowed.
