Man with pot in his sock accused of drunk driving a moped
/When a man on a moped was stopped after midnight Wednesday in Linton because his headlight wasn’t working, he admitted he’d been drinking earlier. On the way to jail, he admitted he had marijuana stashed in his sock.
Larry Eugene Gray, 51, of Dugger, was arrested by Greene County Sheriff’s Deputy Alan Jackson after Jackson stopped Gray in Linton around 12:30 a.m. Wednesday, March 20.
Deputy Jackson was on patrol on State Road 54 West in Linton when he saw Gray operating a moped with a headlamp that was not illuminated. The deputy followed the moped and said it drove down the middle of a roadway in a turn lane but didn’t use a turn signal when it did turn. Gray was stopped at the intersection of SR 54 and 6th Street NE.
Gray had an Indiana identification card but he did not have a Class B motorcycle endorsement on the card. Gray said the BMV (Bureau of Motor Vehicles) told him he only had to have a license plate and the moped had to be under 49 cc.
Jackson reported Gray admitted he had been drinking earlier and he admitted he had smoked marijuana earlier. Gray agreed to field sobriety testing which he failed on the scene.
Gray was transported to the sheriff’s department and on the way there, when the deputy asked him if he had any drugs on him, Gray allegedly told Jackson he had some marijuana in his sock.
Field sobriety tests were administered a second time at the sheriff’s department - he also failed, and he refused to take a chemical test so the deputy got a search warrant. Personnel from the Greene County Ambulance Service then collected a blood sample which was sent to a lab for testing – results pending.
Deputy Jackson reported that in June of 2003, Gray’s driver’s license was suspended for life for being an habitual traffic violator, and that Gray was last convicted of operating a vehicle while intoxicated in Sullivan County in April of 2017.
Gray’s bond was set at $13,000 surety with ten percent cash allowed but as of late Friday afternoon, he had not posted bond and remained in jail.
When Gray appears in court for his initial hearing, he will be formally charged with:
Operating a motor vehicle after forfeiture of license for life, a Level 5 felony,
Operating a vehicle while intoxicated, a Class C misdemeanor,
Operating a vehicle while intoxicated with a prior conviction, a Level 6 felony,
Operating a vehicle with a Schedule I or II controlled substance in person’s body, a Class C misdemeanor, and
Possession of marijuana, a Class B misdemeanor.
Greene County Sheriff’s Deputies Sgt. Bobby Pierce and Davis Aerne also responded to assist on the scene.
