Man arrested twice in one day

A man found slumped behind the wheel of a truck in a ditch early Wednesday morning was arrested, booked into jail around 8 a.m. then released after posting bond. By 4:30 p.m., he was booked back into jail in a separate incident.

Jesse Roscoe Lumm II, 34, of Elnora, was arrested by Indiana State Police Trooper Richard Klun on Wednesday, February 27. Lumm was booked into the Greene County Jail around 8 a.m. His bond was set at $6,500 surety with ten percent cash allowed. Lumm posted $650 and was released.

By late afternoon, Lumm was back in jail.

Jesse Lumm was arrested by Deputy Camron Frye of the Greene County Sheriff’s Department and booked into jail around 4:30 p.m. the same day.

Early on Wednesday, February 27, both ISP Master Trooper Eric Nash and Trooper Klun responded to a crash with possible injuries located at County Roads 300 South and 700 West in the Lyons area. Someone had called 911 and said there was a man who appeared to be unconscious behind the wheel of a truck that had crashed into a ditch.

When Trooper Nash arrived, he found Lumm slumped down with his forehead resting on the steering wheel of the truck. He said when he opened the door of the truck, there was an overwhelming odor of alcohol, an open bottle of Bud Light in the console and another open Bud Light on the floorboard. He said Lumm was confused and kept saying he was not driving. Lumm got out of the truck, allegedly stumbling, and when asked for his license, he removed two bottles of beer from his jacket pockets.

When Trooper Klun arrived, he said Lumm said he had walked down the road to his truck. Lumm didn’t say how his truck got in the ditch. Trooper Klun reported there were multiple bottles of beer outside the truck, one standing up in the roadway and one near the rear of the truck, both partially full, more in the bed of the truck.

The troopers observed tire tracks in a crop field and mud tracks where tires had been spinning before hitting the ditch. It appeared the driver of the truck was attempting to do a “doughnut” in the mud, lost control and crashed in the ditch.

Trooper Nash completed the crash investigation. Trooper Klun placed Lumm into custody and transported him to the Greene County Jail.

Trooper Klun reported Lumm was respectful at times, but argumentative at other times and cussed at the trooper and told him if he ever saw him in a bar, he was going to get smacked up. At the jail, Lumm allegedly told two jail officers that he was going to beat the trooper if he ever caught him outside of the jail.

The preliminary charges against Lumm as a result of this incident include:

Intimidation, a Level 6 felony,

  • Driving while suspended – a knowing violation with a prior conviction within 10 years, a Class A misdemeanor,

  • Criminal mischief where damage is between $750 and $50,000, a Class A misdemeanor, and

  • Public intoxication that endangers life, a Class B misdemeanor.

After Lumm was released from jail, he was allegedly seen getting into a vehicle with a person who had an active protective order against Lumm.

Lumm was taken into custody and booked back into jail.

A second case was then filed against him for invasion of privacy in violation of a protective order, a Class A misdemeanor.

But that’s not all. Today, Friday, February 28, a warrant was issued for Lumm’s arrest in another ongoing case. In the earlier case, Lumm was arrested by GCSD Sgt. Bobby Pierce on December 22, then charged with two counts of domestic battery resulting in moderate bodily injury, both Level 6 felonies. That case is still pending and he was out on bond. On Friday, a judge found probable cause after the latest incidents that Lumm had violated a condition of his bond and ordered his bond revoked.
