Lyons man faces felony charges after ATV crash, failing sobriety tests

A 43-year-old Lyons man is facing multiple felony charges after allegedly operating an ATV while intoxicated and attempting to flee from a Greene County deputy.

According to court documents filed July 15, Michael D. Kuhlenschmidt was arrested on the evening of July 10 after a high-speed incident involving a blue Honda four-wheeler that ended in a ditch near South Brown Street and County Road 250 South.

Greene County Sheriff’s Deputy Travis Hasler reported that he observed Kuhlenschmidt driving the ATV at a high rate of speed through the intersection of South Brown and East Bogard streets, lifting two wheels off the ground and failing to stop at a posted stop sign.

After a brief attempt to evade law enforcement, which included swerving, nearly crashing, and eventually running the ATV into a ditch, Kuhlenschmidt was detained. Deputy Braden DeMier helped at the scene, where Kuhlenschmidt reportedly struggled to keep his balance, fell multiple times, and lost both shoes while pushing the vehicle.

Deputy Hasler noted a strong odor of alcohol and administered field sobriety tests, which Kuhlenschmidt failed. A preliminary breath test registered a blood alcohol content of 0.168.

Kuhlenschmidt was transported to the Greene County Jail, where further testing recorded a certified blood alcohol concentration of 0.157 — nearly twice the legal limit.

Deputies also discovered that Kuhlenschmidt has two prior convictions for driving while intoxicated, dated December 2022 and April 2024, and that he is currently classified as a habitual traffic violator with identification-only privileges.

He now faces charges of operating a vehicle while intoxicated endangering a person, a Class A Misdemeanor; operating a vehicle while intoxicated endangering a person with a prior conviction within seven years, a Level 6 Felony; operating a vehicle while intoxicated, a Class C Misdemeanor; operating a vehicle while intoxicated with a prior conviction within seven years, a Level 6 Felony; operating a vehicle with an alcohol concentration equivalent to .15 or more, a Class A Misdemeanor; and operating a vehicle with an alcohol concentration equivalent to .15 or more where the defendant has a prior conviction, a Level 6 Felony.
