Jasonville man arrested after trespassing

Trespassing and refusing to leave a property that wasn’t his resulted in the Sept. 5 arrest of a 45-year-old Jasonville man.

Jasonville Police Department Officer Andrew Duguay arrested Shad Lee Robling on charges of criminal trespass, resisting law enforcement, and possession of methamphetamine after he was called to investigate a trespassing complaint on Railroad Street in Jasonville.

Upon arrival, Officer Duguay observed a male subject – later identified as Robling – standing in the yard. According to the probable cause affidavit, Robling was very unsteady on his feet, had jerky movements, and was swaying. Based upon his training and experience, Duguay wrote he believed Robling was under the influence of a controlled substance.

Robling was cursing at the homeowner and telling her to get off of his property. The homeowner told Duguay she did not know Robling and she had never seen him near the property previously. She said she’d told him to leave but he’d refused.

When Robling was told by Duguay to put his hands behind his back, he pulled away and fled onto the porch. Robling, according to the probable cause, asked if he was being arrested on his “f*****g property”. He was informed by Duguay that he was being detained. On the porch, he allegedly ignored multiple orders to turn around and put his hands behind his back. He picked up a baseball-sized rock and began swinging it around. Duguay ordered Robling to drop the rock multiple times; however, he refused. Duguay, according to the probable cause affidavit, deployed his Taser, connecting with Robling, causing him to drop the rock. Duguay attempted to handcuff Robling, but he continued to resist and refuse orders; therefore, Duguay deployed his Taser a second time.

Greene County Ambulance evaluated Robling at the scene due to his intoxication level. When Duguay performed a search of his person, a small metal tin containing a white crystal-like substance was located. The substance later field-tested positive for methamphetamine.

Robling was transported to Greene County Jail where his bond was set at $10,000 surety with 10% cash allowed.

He appeared in Greene Superior Court on Sept. 7 for an initial hearing.
