Bloomfield man arrested after concerned citizen reports confused driver
/A 73-year-old Bloomfield man was arrested May 27 after deputies responded to reports of a confused driver repeatedly pulling into driveways in the Solsberry area.
Dennis V. Brown faces preliminary charges of operating a vehicle while intoxicated, possession of marijuana and possession of paraphernalia.
According to a supplemental probable cause affidavit filed in Greene Superior Court, the Greene County Sheriff's Office received a call around 6:28 p.m. from a concerned citizen who reported a man driving a silver Toyota Camry appeared confused and lost.
The caller allegedly told deputies the driver had stopped on North Woodview Hills Court and said he was lost. The caller reportedly attempted to convince Brown to stay with him because he appeared confused, but Brown drove away.
According to the affidavit, the caller continued following Brown out of concern for his driving and later stopped with him at the Sylvania Wesleyan Church on East Sylvania Road.
Deputies Herschel Blankenship and Tanner Carter arrived shortly afterward and made contact with Brown, who reportedly stated he was returning home from the American Legion.
Court documents state deputies observed Brown displaying delayed responses, slurred speech and red, glassy eyes. Deputies also reported smelling the odor of an alcoholic beverage coming from Brown.
According to the affidavit, Brown agreed to field sobriety testing. A portable breath test allegedly showed a blood alcohol concentration of .044, though deputies stated they believed Brown appeared more impaired than the test result indicated.
Investigators allege Brown showed multiple clues of impairment during field sobriety testing and later refused to submit to a chemical test after being advised of Indiana’s implied consent law.
While deputies were reading Brown his Miranda rights, the affidavit alleges Brown walked away and dropped a plastic bag over a nearby fence. Deputies reportedly recovered the bag, which allegedly contained suspected marijuana and a glass smoking device. The substance later field-tested positive for marijuana.
According to court documents, Brown told deputies, “It’s just marijuana,” when asked about the contents of the bag.
A search warrant for Brown’s blood was later obtained and executed the same evening. Results are pending.
