Worthington man charged with operating a vehicle while intoxicated

A Worthington man, who bonded out of jail after he was arrested in late August then was given permission to travel out of state for a job, was charged with operating a vehicle while intoxicated when he appeared in court late last week.

Dickie Allen Phillips, 41, was arrested on Friday evening, August 31, by Deputy Marshal James T. Harrington of the Worthington Police Department.

Harrington was dispatched to a Wabash Avenue neighborhood in Worthington after someone reported Phillips was driving erratically.

When Harrington arrived around 7:30 p.m., he spoke with three residents in the area who told him Phillips had just run over a dog, almost run over a mailbox and left ruts in a yard. They said he had driven forward at a high rate of speed from his home south to Terre Haute Road then drove his vehicle north back to his residence at a high rate of speed, in reverse.

Harrington also spoke to family members of Phillips but he was unable to locate him at his home or in the neighborhood and believed he had left town headed west on Terre Haute Road.

Harrington advised dispatch of the situation and a deputy spotted Phillips in Linton.

Greene County Sheriff’s Deputy David Elmore and Det. Shawn Cullison then located Phillips at the Park Inn and detained him.

Officer Harrington drove to their location and reported Phillips showed signs of impairment, failed field sobriety testing and blew a .109 on a portable breath test.

Phillips was transported to the Greene County Sheriff’s Department where he again failed field sobriety testing, became belligerent about taking a chemical test then agreed to one before becoming belligerent again. Harrington said Phillips threw a clipboard.

A search warrant for a blood draw was granted and executed by a paramedic – results are pending.

Harrington said he reviewed Phillips’ records and he did not have a previous conviction for an OVWI offense.

Bond was set at $8,000 surety with ten percent cash allowed. Phillips posted $800 cash and was released on September 1 and given a date to appear in court. Phillips then requested and was granted permission to leave the state for employment purposes and the court granted a continuance and reset the date for last Thursday, September 20.

When Phillips appeared in Greene Superior Court for the initial hearing, he was charged with operating a vehicle while intoxicated endangering a person – a Class A misdemeanor, and operating a vehicle while intoxicated – a Class C misdemeanor.
