Woman battered by man who was ordered to have no contact with her
/A Bloomfield man was arrested last Friday after the sheriff's department received a report that a woman’s face was beaten and bloody even though she had a valid protective order against him.
Cody Ray Byers, 24, Bloomfield, was arrested by Deputy Devan Goad of the Greene County Sheriff's Department last Friday, November 18.
Last Friday afternoon around 1:16 PM, the Greene County Sheriff's Department talked to a man who said he'd received a picture of his sister and her face was “beaten and bloody.” He suspected Cody Byers and said his sister had a protective order against him. He said they were still at a residence on Old Worthington Road, Bloomfield, and there were children there with them.
Deputy Andrew Weeks and Deputy James Carpenter responded to the residence to check on the woman's welfare but she was not there and had returned to her apartment in Bloomfield. Bloomfield Town Marshal Ken Tharp was first to arrive at that residence to check on the woman.
When he arrived and knocked on the door, she opened it and talked to him. He said she had fresh cuts on her nose and face area along with swelling on the left side of her face. She said nothing had happened and that Byers was not inside the residence yet she kept shaking her head in an up and down motion to indicate that he was inside. Then two juvenile children stepped outside and one of them said that Byers was being mean to mommy and threw her phone.
When Deputy Goad arrived on the scene, he entered the residence with Marshal Tharp and Byers was given orders to come out of a bedroom and get on the ground. He was handcuffed and escorted out of the residence but he kept trying to pull away to go talk to the woman.
The woman said the argument started because she wouldn't watch pornographic movies with Byers and it escalated. She alleged Byers had hit and kicked her in the bedroom leaving multiple cuts and knots on her face. He also allegedly broke a lot of things around the house as well as a door. She said a couple of days before that, he had choked her to the point that she was dizzy and almost passed out and she reportedly had visible marks and bruising on her neck. One of the juveniles said Byers had bitten his mommy's finger and she confirmed that all of the events that occurred happened with the children present in the bedroom.
When Deputy Goad attempted to talk to Byers about what had happened, Byers was allegedly belligerent and didn't want to give details but said he had been beaten up by the woman and he had multiple bumps and knots on the top of his head but when Deputy Goad felt his head, he could not feel any knots.
Byers was transported and booked into the Greene County Jail at 2:13 PM.
According to Deputy Goad, there was a valid protective order issued on October 18 protecting the woman and ordering Byers to have no contact with her.
Byers was initially held without bond. During his initial hearing earlier today, he was charged with:
Domestic battery committed in the presence of a child less than 16 years old, a Level 6 felony,
Invasion of privacy in violation of a protective order, a Class A misdemeanor, and
Strangulation, a Level 6 felony.
Court records show Byers has two other cases pending against him.
In one which stemmed from an incident that occurred in late May, he was found guilty of battery resulting in bodily injury, a Class A misdemeanor, and sentenced but in October a petition to revoke his suspended sentence was filed.
The other case stemmed from an incident that occurred on October 7. He was charged with:
Domestic battery committed in the presence of a child less than 16 years old, a Level 6 felony,
Criminal mischief, a Class B misdemeanor, and
Reckless driving at unreasonable speed that endangered safety, a Class C misdemeanor.
He bonded out of jail and the no contact order was issued.
Earlier today as a result of the latest case filed against him, a petition to revoke his bond was filed, due to a violation of a condition of his bond release, and a warrant was issued for his arrest. The warrant will be read to him in jail and he will likely be held without bond.
