Updated with clarifications: Linton man accused of breaking a woman’s arm during domestic dispute
/A Linton man was arrested Monday for allegedly breaking a woman’s arm during an argument then later intimidating her with a threat to post personal photos on social media.
David Wayne Alton, 49, of Linton was arrested early Monday morning, September 9, by Officer Nick Yingling of the Linton Police Department.
When Officer Yingling talked to the woman, she said she had been in an argument with Alton that became physical.
The woman later explained that she had left the home to visit with a female friend for approximately 45 minutes, and when she returned, Alton was upset and the argument started because he thought she was seeing someone else.
According to Officer Yingling, she claimed that during the argument, Alton came at her “mad and fast,” grabbed her by the throat which caused bruising as well labored breathing, and grabbed her left arm, twisted it behind her back and pulled. She said she heard a loud pop.
The woman allegedly said she used her other elbow to swing at him and it hit him in the mouth causing him to have a swollen lip. She allegedly said he let her go, told her to get the kids and leave. She said she woke two children, had them go to a vehicle and they left. She contacted a friend who met her and drove her to the hospital.
After this interview, the woman contacted the police department again to say Alton was sending her text messages telling her to call him or he would post nude pictures of her on Facebook.
When Officer Yingling was able to make contact with Alton, he said the woman elbowed him and he pushed her. He denied anything else happened. When asked about the text messages, he allegedly said he did not message her.
Officer Yingling seized Alton’s phone and asked for a search warrant. He reported the phone will be analyzed.
However, Yingling reported that on the woman’s phone, he observed a text message that appeared to be from Alton, requesting she contact him within a few minutes or he would post the photos of her on Facebook.
To follow up, Yingling spoke to the woman again yesterday, later in the day, and learned her left arm was broken.
In addition, a witness was at the residence where the altercation occurred. The witness was the significant other of a female friend of the victim. The friend had asked him to go to the residence to assist the victim. He allegedly told Yingling he was outside the residence when he heard yelling and then saw the woman leaving the residence and saw Alton push her before she left in her vehicle.
Alton’s bond was set at $15,000 surety with ten percent cash allowed. As of Tuesday evening, he had not yet posted bond and was still in jail.
On Tuesday, September 10, a criminal case was filed against Alton and by 1:30 p.m., he was appearing in Greene Circuit Court for an initial hearing.
Alton has been charged with:
Battery resulting in serious bodily injury, a Level 5 felony,
Strangulation, a Level 6 felony, and
Intimidation, a Class A misdemeanor.
