Man accused of pointing a firearm and drunk driving

A 45-year-old Worthington man found himself behind bars on June 10 after allegedly pointing a firearm at another person and driving while under the influence of alcohol. 

Darin Stalcup was arrested by Worthington Police Department Chief Jacob Gambill on charges of intimidation, pointing a firearm at another, operating a vehicle while intoxicated, and operating a vehicle while intoxicated endangering a person. 

Gambill responded to a report of an incident involving a firearm. The reporting party told Gambill he and another individual were driving on County Road 250 West behind a RZR. The caller alleged the driver’s behavior made them think he was intoxicated. According to the probable cause affidavit, the caller said the driver – later identified as Stalcup – pulled over as if to let them go around, then began riding their bumper. The caller said they pulled over into a business lot and exited the vehicle to see why Stalcup was riding their bumper. According to the probable cause, the caller said Salcup then got out of the RZR, pulled out a small black handgun, racked the slide, and pointed it at them twice before leaving. 

Gambill, along with officers from the Worthington Police Department, Greene County Sheriff’s Department, Jasonville Police Department, and Bloomfield Police Department went to Stalcup’s residence. There, according to the probable cause affidavit, Stalcup insisted he tell his side of the story. He alleged the callers almost ran him off the road. When the passenger got out, Stalcup said he displayed the firearm, which he alleged wasn’t loaded, and told the individual he doesn’t fight. According to the probable cause affidavit, he denied pointing the firearm. 

Stalcup consented to a search of his residence. During the search, a black Ruger LCP .380 handgun with a full magazine was located. Also located was a 2018 Polaris RZR.

While speaking with Stalcup, Gambill wrote in the probable cause that an odor of alcohol could be detected from his breath. When asked if he had consumed any alcoholic beverages, Stalcup alleged he drank five beverages, the most recent an hour prior. When a portable breath test was administered, Staclup’s results returned a .210. 

Stalcup was transported to the Linton Police Department where a Standardized Field Sobriety Test was conducted by Greene County Sheriff’s Department Deputy Harvey Holt. Stalcup failed. 

Stalcup consented to a blood draw and was transported to Greene County General Hospital, results are pending. 

Stalcup was transported to Greene County Jail where his bond was set at $22,000 surety with 10% cash allowed. He was released after posting $2,200. 

He is scheduled to appear in Greene Superior Court in June 19. 

He is facing charges of: 

• Intimidation, a Level 5 Felony

• Pointing a firearm at another, a Level 6 Felony

• Operating a vehicle while intoxicated endangering a person, a Class A Misdemeanor

• Operating a vehicle while intoxicated-first offense and no endangerment, a Class C Misdemeano
