A Linton man has been summoned to appear in Greene County Superior Court in February after failing to take a deer to a check-in station and hunting deer with excess cartridges.

On Dec. 11, a summons to appear in court on Feb. 8 was issued to Myles Hurst on charges of failure to take a deer to a checking station and hunting deer with excess cartridges.

According to a probable cause affidavit written by Indiana Conservation Officer Cole Hollingsworth, he encountered two male hunters on private property on Nov. 26. One was identified as Hurst.

Hurst, according to the probable cause affidavit, was carrying a Ruger AR-10 pattern style semi-auto rifle, .308-win caliber loaded with 17 .308 win cartridges. Hollingsworth noted in the probable cause that state law allows a hunter to possess no more than 10 rounds of firearm ammunition when hunting deer with rifles.

Hurst alleged he killed a female whitetail deer on Nov. 18 but denied harvesting any other deer. While Hollingsworth was speaking with the other hunter, he alleged Hurst had shot a small doe but wasn’t sure if he’d checked it in because they’d processed it themselves.

According to the probable cause, Hollingsworth asked Hurst to tell him how many deer he had shot this season. Hurst first alleged just one, but later admitted to killing two deer this season.

Hollingsworth seized Hurst’s weapon and informed him he would be receiving a summons to appear in court.
