Linton man arrested for domestic battery accused of carrying a handgun without a license

Several officers responded to a domestic dispute in Linton involving a man who was carrying a gun but did not have a permit to carry. He was in court Monday and has been charged with a felony.

Carl Lee Pennington, 30, Linton, was charged with domestic battery committed in the presence of a child less than 16, a Level 6 felony, and carrying a handgun without a license, a Class A misdemeanor, when he appeared in court for an initial hearing on Monday, June 8.

Pennington was arrested by Officer John Agan of the Linton Police Department early Tuesday, May 26.

Officer Agan was dispatched around 12:30 a.m. to a residence on 3rd Street NW in Linton when police were alerted about a domestic in progress with children present in the residence. LPD Officers Kyle Robison, Adam King and Janzen Franklin also responded.

When they arrived, they learned a verbal then physical altercation had started hours earlier. Officer Agan talked to a woman who said she had been battered by Pennington and two children were present and had witnessed the altercation. She also said Pennington was carrying a gun, and at one point when they were outside, Pennington had pointed the gun at her and fired one round into the ground in front of her. She also alleged that Pennington had physically hit, grabbed and pushed her numerous times. Pennington had left the residence before officers arrived.

Two officers left in an attempt to locate Pennington. Two officers stayed at the residence then when she sought treatment at the hospital, they traveled there and took a statement from her at the hospital. Officer Agan reported the woman had redness and scratches on her back, legs and neck and redness in the shape of a hand on her body.

Pennington was located standing on a bridge at the Goosepond pull-off on South State Road 59 with a vehicle nearby. He was taken into custody. Officer Robison reported a black Diamond Back .380 semi-auto pistol, disassembled with the slide off. The magazine contained five bullets.

Officers were unable to find a shell casing at the residence.

Pennington was transported to the police department where he was interviewed by LPD Sgt. Logan Hobbs who reported Pennington admitted hitting the woman but denied pulling or dragging her, and he denied pointing or shooting the pistol during the altercation. He said he only carries five bullets because the pistol will malfunction when he puts in all six. He allegedly said he always has his .380 on him, but also told Sgt. Hobbs that he does not have a permit to lawfully carry a handgun.

Pennington was booked in to the Greene County Jail around 3:30 a.m. His bond was set at $2,000 surety with ten percent cash allowed. He has since posted $200 and been released. He has been served with a protective order.
