Linton man accused of OWI with BAC more than twice legal limit
/A 23-year-old Linton man is facing multiple operating while intoxicated charges after police allegedly stopped him for speeding in a school zone and later recorded a blood alcohol concentration more than twice Indiana's legal limit.
Jesse Martinez-Cartwright was arrested June 1 on preliminary charges of operating a vehicle while intoxicated endangering a person, a Class A misdemeanor; operating a vehicle while intoxicated with an alcohol concentration equivalent of 0.15 or more, a Class A misdemeanor; and operating a vehicle while intoxicated, a Class C misdemeanor.
According to court documents, Linton Police Department Officer JR Blazier was patrolling near Fourth Street Northeast around 9:34 p.m. when he observed a silver GMC SUV allegedly traveling 45 mph in a 25 mph school zone.
The officer initiated a traffic stop, and the vehicle eventually stopped north of Linton near German Cemetery.
According to the affidavit, the officer observed open beer cans inside the vehicle and detected the odor of alcohol coming from Martinez-Cartwright. The officer also reported that Martinez-Cartwright had glassy eyes and slurred speech.
A passenger in the vehicle reportedly told police the open containers belonged to him.
Police said Martinez-Cartwright admitted he had been drinking and agreed to perform standardized field sobriety tests. Court documents state he showed multiple signs of impairment during the tests and registered a preliminary breath test result of 0.17.
In addition to the open beer cans, investigators also reported locating two cases of beer inside the vehicle.
Martinez-Cartwright was transported to the Linton Police Department, where additional field sobriety tests were conducted. According to the affidavit, he again showed signs of impairment and consented to a certified chemical breath test.
Police allege the test produced a result of 0.17 grams of alcohol per 210 liters of breath, more than twice Indiana's legal limit of 0.08.
After being advised of his rights, Martinez-Cartwright reportedly told officers he had consumed between four and seven mixed drinks containing vodka as well as beer while fishing earlier in the evening. According to court documents, he also acknowledged feeling the effects of alcohol and admitted one of the open beers in the vehicle belonged to him.
Martinez-Cartwright was transported to the Greene County Jail without incident.
He is scheduled to make an initial appearance in Greene Superior Court on June 8.
