Evan Ross Porter was arrested by Jasonville Police Department Officer Brian Pilant on a preliminary charge of battery resulting in bodily injury after Pilant responded to an incident on South Railroad Street.

When Pilant arrived at the scene, he spoke with the victim who stated she and Porter had been in an argument. She told Pilant Porter said if she wasn’t a woman, he’d slap her. The victim said she told Porter to bring it on. She said Porter then came at her, grabbed her by the neck and shoved her into the stove. She said he drew his fist back as if he was going to hit her, but he did not. Pilant wrote in the probable cause affidavit that he didn’t observe any marks on the victim.

Porter said he and the victim exchanged words, his frustration built up, and he exploded. He said the victim was trying to provoke him and he got so mad and shoved her against the stove. However, Porter said he never put his hands on the victim and said the victim never put her hands on him. Officer Pilant asked Porter if he had access to a door to which Porter said yes. Pilant said he could have just walked out the door and the incident would not have happened. Porter again told Pilant he didn’t put his hands on the victim, he just shoved her. Pilant informed him that shoving the victim was in fact battery.

Pilant interviewed a female witness who said the two were arguing. She said Porter grabbed the victim around the neck and shoved her into the stove.

Pilant later interviewed the witness at the police station where he asked her to rate her pain on a level of one to 10. She rated her pain at a seven.

Porter was arrested on a preliminary charge of battery resulting in bodily injury, a Class A Misdemeanor.

He was transported to Greene County Jail where his bond was set at $1000 surety with 10% cash allowed. He later posted $100 bond and was released.
