Driver arrested for operating while intoxicated in Linton

A Linton man was arrested in the early hours of May 11 after police say he was operating a vehicle while intoxicated, with a blood alcohol concentration above the legal limit.

According to a probable cause affidavit filed in Greene Superior Court, Linton Police Department Lt. Davis Aerne conducted a traffic stop after observing a vehicle traveling westbound on State Road 54 with a license plate light out.

The driver, later identified as Brennen J. Martin, 21, reportedly appeared confused during the stop and emitted a strong odor of alcohol. Lt. Aerne requested assistance from Officer Cade Herndon, who arrived on scene and conducted a series of standardized field sobriety tests.

Martin allegedly failed multiple components of the sobriety test. Preliminary breath tests at the scene indicated blood alcohol concentrations of 0.138 and 0.128—one administered by Aerne and the other by Herndon.

Martin agreed to submit to a certified chemical test and was transported to the Linton Police Department, where a certified breath test was administered. The result showed a blood alcohol concentration of 0.140, above the legal limit of 0.08.

During a vehicle inventory, Herndon reportedly discovered an open case of Busch Light Apple in the back seat and an open, cold can of the same beverage on the floorboard behind the driver’s seat.

Martin faces misdemeanor charges of operating a vehicle while intoxicated and operating a vehicle while intoxicated with an alcohol concentration equivalent to at least 0.08 but less than 0.15.

He was transported to the Greene County Jail, where bond was set at $4,000 surety with 10% cash allowed. He was released after posting $400.
