Driver accused of reckless driving in an impaired state

A driver clocked at 82 in a 55, with a license plate that expired in 2012, was arrested and is expected in court on Thursday. He’s suspected of driving while impaired.

Bret Thomas Carmichael, 48, Springville, was arrested on Friday morning, November 8, by Indiana State Police Trooper Richard Klun. Carmichael’s bond was set at $5,000 surety with ten percent cash allowed. He posted $500 and was released on November 9. Carmichael is scheduled to appear for an initial hearing in Greene Superior Court on Thursday.

Carmichael is facing charges of:

  • Operating a vehicle while intoxicated endangering a person, a Class A misdemeanor,

  • Possession of marijuana, a Class B misdemeanor,

  • Operating a vehicle with a Schedule I or II controlled substance in person’s body, a Class C misdemeanor, and

  • Reckless driving at unreasonable speed that endangers safety, a Class C misdemeanor.

Trooper Klun was on State Road 45 near East Miller Lane in Greene County when he noticed a pickup truck traveling at a high rate of speed. Radar clocked the truck going 82 mph in a 55 mph zone. The trooper and the truck were traveling in opposite directions so Klun turned around and said it took him two miles to catch up. The truck was then stopped on State Road 45, Springville, still in Greene County.

Carmichael was identified as the driver of a black 2004 Chevrolet Silverado, with an expired license plate. The plate was old, with a sticker that expired in 2012. When asked about that, Carmichael allegedly said his “plate got stole.”

In a probable cause affidavit prepared by Trooper Klun, he describes behavior that indicated impaired driving. For one, while the trooper was sitting in his patrol vehicle behind the truck, the truck rolled forward about 30 feet before Carmichael hit the brakes hard, then backed it up close to the patrol vehicle and left it in reverse. When asked to put the truck into park, the truck started to roll backward again with the trooper yelling stop.

When asked to exit the truck, the trooper noticed a hand-rolled cigarette, partially burnt, sitting on the rubber seal of the driver’s side window.

Trooper Klun reported when the truck was searched, multiple items of paraphernalia were located plus green plant-like material.

Carmichael did not do well on a standard field sobriety test and was transported to Monroe Hospital for a blood draw before being transported to jail.

Trooper Klun reported Carmichael was cooperative at the hospital and was arrested without incident, and he also noted that during the stop, Carmichael had offered him a mint.
