Banging on a house and screaming leads to disorderly conduct charge

A call regarding a subject banging on someone’s house and windows and screaming resulted in the arrest of a 40-year-old Linton man on charges of disorderly conduct and possession of paraphernalia.

On Dec. 20, Linton Police Department Officer Janzen Franklin responded to a call after a resident contacted the Linton Police Department about a male subject, later identified as Theodore James Miller, banging on her house and windows and screaming at her. 

Franklin and Officer Alan Jackson went to Miller’s residence to speak with him about the incident. While on the front porch of his residence, Franklin observed a blue and clear smoking device containing burnt residue. Miller allegedly told Franklin it could have been a marijuana pipe or a tobacco pipe, admitting that he smoked marijuana. Franklin detected an odor of marijuana from the pipe. 

Miller began yelling and Officer Jackson advised him that if he continued to make unreasonable noise, he would go to jail for disorderly conduct.

When leaving the residence, Miller, according to the probable cause affidavit written by Franklin,  began yelling for help unreasonably loudly. He was taken to Greene County General Hospital where he was medically cleared to be transported to Greene County Jail. 

While at the hospital, he allegedly admitted to using marijuana and methamphetamine.

Miller’s bond was set at $1,000 surety with 10 percent cash allowed.

He appeared in Greene Superior Court on Dec. 22 for an initial hearing and was formally charged with: disorderly conduct, a Class B Misdemeanor and possession of paraphernalia, a Class C Misdemeanor.
