Springville man arrested on OWI charge after parking behind deputy

A Springville man was arrested early on the Fourth of July after he allegedly drove into a school parking lot, became sick outside his vehicle, and later registered more than twice Indiana's legal blood alcohol limit.

Logan Michael Russell, 21, of Springville, was arrested at 2:08 a.m. July 4 on a preliminary charge of operating a vehicle with an alcohol concentration equivalent (ACE) of .15 or more, a Class A misdemeanor.

According to a probable cause affidavit, a Greene County Sheriff's deputy was parked in the student parking lot at Eastern Greene High School around 1 a.m. when a 2007 Toyota Camry pulled into the lot and parked directly behind the marked patrol vehicle.

As the deputy approached to check on the driver, identified as Russell, he observed what appeared to be vomit on the side of the vehicle and a puddle of fluid on the ground beneath the driver's door. Russell told the deputy he had become sick while driving.

The deputy reported detecting the odor of an alcoholic beverage on Russell's breath and observing glassy eyes and dilated pupils. According to the affidavit, Russell admitted he had been drinking Michelob beer approximately three hours earlier and said he was coming from a Fourth of July gathering with friends.

When Russell exited the vehicle, the deputy noted he appeared unsteady on his feet.

Court documents state Russell displayed six of six clues of impairment during the horizontal gaze nystagmus test. Although Russell told the deputy he had a previous knee injury that affected his balance, investigators also documented multiple clues of impairment during the walk-and-turn and one-leg stand tests.

Russell declined to take a portable breath test but agreed to a certified chemical breath test after being advised of Indiana's implied consent law.

According to the affidavit, the certified breath test administered at the Greene County Sheriff's Office measured Russell's blood alcohol concentration at 0.157 grams of alcohol per 210 liters of breath.

Russell was booked into the Greene County Jail on preliminary charges of operating a vehicle with an ACE of .15 or more and operating a vehicle while intoxicated.

Russell's bond was set at $4,000 surety with 10% cash allowed. He was later released after posting $400.
