Former Shakamak bus driver, pastor accused of sexual misconduct with a 14-year-old

A Terre Haute pastor and former Metropolitan School District of Shakamak bus driver has been accused of engaging in a sexual relationship with a 14-year-old girl, leading to two Level 4 felony counts of sexual misconduct with a minor.

According to a probable cause affidavit filed in Vigo County Court, the investigation began after the Terre Haute Police Department's Juvenile Unit received allegations regarding Tracy Wayne Hamilton, 62, and an inappropriate relationship with the juvenile. Detectives interviewed multiple witnesses, conducted forensic interviews at Susie's Place, and executed a search warrant as part of the investigation.

Court documents state one witness reported seeing Hamilton and the juvenile together in a vehicle approximately a year ago and witnessing what he described as an intimate kiss between the two. The witness told investigators he did not report the incident at the time because he was no longer attending Hamilton’s church.

During forensic interviews, investigators learned Hamilton had frequently spent time alone with the juvenile and her family. According to the affidavit, witnesses told detectives Hamilton accompanied the family on a recent trip to Mississippi, where he and the juvenile allegedly stayed in separate hotel rooms from the rest of the family. Investigators also received statements alleging the juvenile had been staying in a camper where Hamilton was living in the weeks leading up to the investigation.

The juvenile, according to the probable cause affidavit, told investigators she had sexual relations with Hamilton twice, both inside the camper.

Detectives executed a search warrant at the residence on July 14, recovering the juvenile's cellphone and collecting additional evidence from the camper. During follow-up interviews on July 15, the juvenile disclosed details of the alleged relationship, according to court records.

Hamilton was later located by detectives and agreed to speak with investigators at the Terre Haute Police Department. According to the affidavit, Hamilton denied having a sexual relationship with the juvenile and denied kissing her. However, after consenting to a search of his cell phone, detectives reported finding multiple photographs of Hamilton and the juvenile together, including images recovered from the phone's recently deleted folder. When investigators showed Hamilton a photograph depicting the two kissing, he acknowledged the image appeared genuine but said he did not recall the incident, according to court documents.

Based on witness statements, forensic interviews, physical evidence, and other information gathered during the investigation, the Vigo County Prosecutor's Office requested probable cause for Hamilton's arrest on two counts of Level 4 felony sexual misconduct with a minor. Prosecutors also requested a $50,000 cash bond while formal charging decisions are pending.
