Driver arrested for OVWI after almost hitting an officer’s patrol vehicle
/After consuming alcohol at the bar where he works, a Linton driver allegedly was swerving, crossed center and almost hit an oncoming patrol vehicle driven by a JPD officer.
Cody Michael Shake, 30, Linton, was arrested by Officer Skylar Scott of the Jasonville Police Department early Sunday, December 12.
JPD Officer Scott was westbound on State Road 54 going through Linton around 1:45 a.m. on Sunday, Dec. 12., when an eastbound green 2010 Toyota Tacoma attracted his attention. Officer Scott said when the Toyota went through the intersection of SR 54 and 4th Street NE in Linton, it crossed the center turn lane of the highway and entered the westbound lane of traffic, and almost hit Officer Scott’s vehicle. Officer Scott said after he turned around to stop the Toyota, he saw it swerving all over the roadway. It then turned on its left turn signal but turned right into a driveway.
Officer Scott also turned into the driveway with his red and blue lights on. The driver of the Toyota was identified as Cody Shake. Officer Scott reported Shake showed signs of intoxication including glassy eyes and slow and slurred speech.
When asked if he’d been drinking, Shake allegedly said he’d had one beer at the Vault. When asked if he lived at the residence where he turned into the driveway, he allegedly said he did. But when asked what the address was, Shake then said it was not his residence and admitted he was going to a gas station.
Officer Scott attempted to conduct standard field sobriety tests but reported that due to Shake’s level of intoxication and his use of a prosthetic leg, he was unable to complete the testing. Shake refused to submit to a chemical breath test and was transported to the Linton Police Department to wait while Officer Scott requested a search warrant.
While waiting, Shake allegedly admitted he’d actually had a couple of shots and a few beers at the Vault where he works.
After the search warrant was issued, Shake was transported to Greene County General Hospital for a blood draw – results pending.
Shake was booked into the Greene County Jail at 4:52 a.m. with bond set at $8,000 surety with ten percent cash allowed. He posted $800 and was released later the same day.
Shake has a prior – he was convicted last May of operating a motor vehicle while intoxicated endangering a person, a Level 6 felony.
Shake is scheduled to be in Greene Superior Court on January 6 for an initial hearing on a charge of operating a vehicle while intoxicated endangering a person, with a prior conviction within seven years, a Level 6 felony.
Linton Police Officers Bobby Pierce and Cayden Walker and JPD Officer Dustin Cain assisted on the scene and with transportation.
