Update: Bond has been set for Elijiah Gwyn at $83,000 surety with ten percent cash allowed. To be released from the Greene County Jail on the charges in this case, he would need to post $8,300 cash.

Elijiah David Scott Gwyn, 21, was booked in to the Greene County Jail over the weekend as a result of an Indiana State Police investigation into a shooting incident in Linton. On Monday afternoon, the Greene County Prosecutor’s Office filed a criminal case against Gwyn in Greene Superior Court. Gwyn is facing nine serious felony counts.

Details included in probable cause documents were not released on Monday before the courts closed for the day – because the charges had not yet been approved by the court at that time.

However, a reliable source confirmed that the following charges have now been approved:

Count 1. Aggravated battery – assault posed a substantial risk of death, a Level 3 felony
Count 2. Battery resulting in bodily injury, a Level 5 felony
Count 3. Carrying a handgun without a license – defendant has a prior conviction for carrying a handgun without a license, a Level 5 felony
Count 4. Pointing a firearm at another person, a Level 6 felony
Count 5. Pointing a firearm at another person, a Level 6 felony
Count 6. Criminal recklessness – defendant shoots a firearm into a building, a Level 5 felony
Count 7. Criminal recklessness – defendant shoots a firearm into a building, a Level 5 felony
Count 8. Criminal recklessness – defendant shoots a firearm into a building, a Level 5 felony
Count 9. Criminal recklessness – defendant shoots a firearm into a building, a Level 5 felony

It is expected that some details surrounding this case, necessary to prove probable cause, will be released very soon, but they are not expected to be available this evening (Monday).

The Indiana State Police is conducting the investigation, in cooperation with the Linton Police Department.

The shooting occurred sometime before 4 a.m. Sunday. The ISP was called in around 5 a.m. Sunday.

According to Sgt. Curt Durnil, public information officer at the ISP Bloomington Post, detectives discovered a person had been shot at a residence at 249 G Street in Linton. The victim suffered a gunshot wound to the arm – a non-life-threatening injury.

Gwyn was initially booked in by ISP Detective Stacy Brown on charges that were slightly different than what has been filed in the court, including attempted murder which would be a Level 1 felony. This is not unusual for the exact charges to change once a case is filed in court. When an individual is booked in to jail, they are held on preliminary charges based on the recommendations of the investigating and arresting officers at the time of the arrest. Investigations then continue, more information comes to light or is clarified, and the details and conclusions are then submitted to the prosecutor’s office. The prosecutor makes the charging decisions and files criminal cases in the courts.

This case was filed by Greene County Chief Deputy Prosecutor Keven McIntosh.

In the initial information released by the Indiana State Police and reported by most media outlets, Gwyn was listed as being from Linton. He may now live in Linton, but when Gwyn was booked in to the Greene County Jail, around 9:30 a.m. Sunday, the official jail record shows he has a home address in rural Worthington. Court records also show Gwyn with the same home address in rural Worthington.
