An officer reported that when he stopped to help and called an ambulance for a man lying on the sidewalk claiming his knee was shattered, the man reacted by yelling profanity. Turned out his knee wasn’t shattered and he went to jail for disorderly conduct.

Joseph David Kellay, 23, from Battle Creek, Michigan, was arrested early Saturday, September 28, by Officer Dustin Cain of the Jasonville Police Department.

Officer Cain was on patrol on Main Street in Jasonville when he saw a man lying on the sidewalk with another man standing nearby. Cain said he pulled over to see what was going on.

The man on the sidewalk was identified as Kellay. The man who was standing explained that he and Kellay were in Jasonville for the annual homecoming festivities and they had been drinking at an establishment in Jasonville.

Officer Cain said when he asked Kellay why he was on the sidewalk, Kellay immediately became belligerent and started cussing at the officer. Kellay allegedly said his knee was shattered, but he could not explain how it happened.

Officer Cain requested an ambulance for Kellay but Kellay allegedly said he would fight the EMTs and he continued to yell profanity saying he didn’t want them to touch him.

When the ambulance arrived, Kellay was handcuffed and placed on a gurney then transported to Greene County General Hospital with Officer Cain traveling behind the ambulance.

Although Kellay was reported to have been uncooperative, loud and belligerent in the emergency room, an x-ray was taken of Kellay’s knee. Staff later said there was no injury to the knee but Kellay’s blood-alcohol level was .31.

Kellay was booked into jail around 5 a.m. His bond was set at $500 surety with ten percent cash allowed. He posted $50 and was released.

Kellay is currently scheduled to appear in court later in October on a preliminary charge of disorderly conduct – unreasonable noise, a Class B misdemeanor.
