Man arrested after allegedly urinating in public at Linton's Humphreys Park
/A 31-year-old Bloomington man was arrested Sunday, Oct. 25, after a Linton police officer responding to a welfare check allegedly found him urinating in public near Miner Mini Golf at Linton’s Humphreys Park.
Bryce C. Vandivier faces preliminary charges of public nudity, a Class C misdemeanor, and public intoxication, a Class B misdemeanor.
According to a probable cause affidavit filed Monday in Greene County court, Linton Police Officer Bracey Breneman was dispatched to the park at approximately 4:22 p.m. Sunday to check on a man reportedly sleeping on a park bench.
Upon arriving, Breneman reported finding Vandivier near the north fence line of Miner Mini Golf, urinating while facing State Road 54. The officer stated Vandivier's genitals were visible from the roadway.
When Breneman approached Vandivier, he noticed the man appeared to be impaired, according to the affidavit.
Breneman reported Vandivier struggled to answer questions, form complete sentences, or keep his eyes open during their interaction.
When asked whether he had consumed alcohol, used drugs, or was experiencing a medical emergency, Vandivier reportedly indicated he was having a medical issue but could not explain what was wrong.
Breneman reported detecting the odor of alcohol and believed Vandivier was intoxicated. Vandivier denied drinking alcohol that day, according to court documents.
The officer placed Vandivier in handcuffs and escorted him to a patrol vehicle. Breneman reported Vandivier was unsteady on his feet and had difficulty walking in a straight line.
While gathering Vandivier's belongings from the park, Breneman and Officer Cade Herndon discovered multiple empty beer cans among his possessions.
According to the affidavit, Vandivier has two prior convictions for public intoxication in Monroe County.
Vandivier was transported to Greene County General Hospital for medical clearance before being taken to the Greene County Jail.
After receiving medical clearance, Vandivier was transported to the Greene County Jail without incident.
