A Lyons teen has been arrested by GCSD Det. David Elmore as a result of an investigation into an inappropriate sexual incident that allegedly occurred earlier this week. The teen’s case has been filed in adult court and earlier this afternoon, he was charged with rape, a Level 3 felony.
Brayden Q. Delp
Brayden Q. Delp, 17, Lyons, was arrested by Detective David Elmore of the Greene County Sheriff’s Department yesterday afternoon, Tuesday, October 13. Delp was booked into the Greene County Jail at 4:27 p.m.
An investigation actually started sometime the night before, on Monday, October 12, when a woman called 911 and reported Delp had forced himself on a juvenile female. GCSD Sgt. Bobby Pierce responded to a residence on Broad Street in Lyons and then contacted Detective Elmore in the early hours yesterday, Tuesday, October 13.
Det. Elmore, the investigating officer in this case, arrived at the residence around 3:15 a.m. yesterday and met with Sgt. Pierce. When he was notified of the incident, Det. Elmore requested the alleged victim be transported to a hospital so a Sexual Assault Nurse Examiner (SANE) could conduct a sexual assault examination. When Det. Elmore arrived on scene, Sgt. Pierce advised that the alleged victim had left and was being transported to Good Samaritan Hospital in Vincennes as requested.
Sgt. Pierce also advised that GCSD Deputy Alan Jackson had also responded and was transporting Brayden Delp to the Greene County Sheriff’s Department for an interview.
Det. Elmore talked briefly with the caller on the scene then asked them to also go to the sheriff’s department for an interview.
When Sgt. Pierce and Deputy Jackson first got to the residence and were talking to the alleged victim, their conversation was audio recorded and Det. Elmore listened to the recording and reported the victim was able to explain what had happened in detail. Delp is accused of forcing himself upon the victim in inappropriate sexual conduct that included intercourse.
By 6:44 a.m., Delp and the caller, who was Delp’s parent, had been given time for meaningful conversation, had been advised of their rights and agreed to be interviewed. The parent was allowed to be present for Delp’s interview but declined.
Det. Elmore reported that during Delp’s interview, he was forthcoming and he also described the incident in detail. Delp allegedly said the victim told him to stop a few times, but he continued. Delp also allegedly said the victim attempted to physically stop him. When asked if this was the first time an incident like this had occurred, Delp allegedly said maybe there was another time when he was on medication.
Delp was placed under arrest and booked into jail.
Earlier today, Greene County Deputy Prosecutor Keven McIntosh filed a criminal case against Delp as an adult in Greene Superior Court. Also earlier today, Prosecutor McIntosh explained that although Delp is 17 years old, under Indiana law, juvenile defendants accused of more serious crimes, such as murder or rape, may be charged as an adult. That has occurred and in cases such as this, the defendant’s jail record and the probable cause document and other court documents are a matter of public record.
Delp’s bond was set at $15,000 surety with ten percent cash allowed. As of Wednesday afternoon, he had not posted bond and remained in jail.
Delp appeared in Greene Superior Court earlier this afternoon for an initial hearing and was charged with rape – when compelled by force or imminent threat of force, a Level 3 felony.
