A 45-year-old Bloomfield man arrested Sept. 27 after repeatedly crossing the centerline before registering a .128 alcohol concentration on a chemical breath test is scheduled to make his initial court appearance Oct. 5.

James M. Wisniewski faces preliminary Class A misdemeanor operating a vehicle while intoxicated endangering a person, Class C misdemeanor operating a vehicle while intoxicated and Class C misdemeanor operating a vehicle with an alcohol concentration equivalent of .08 or more charges. Court documents indicate the case was filed Sept. 28.

According to a probable cause affidavit, Greene County Sheriff's Deputy Sgt. Jordan Allor was near the roundabout at State Roads 45 and 445 in Solsberry at approximately 2:20 a.m. Sept. 27 when he observed a 2011 Toyota RAV4 enter the roundabout.

Allor reported seeing the vehicle drive over the double yellow centerline before abruptly returning to the northbound lane. He continued following the vehicle and allegedly observed it cross left of center several more times, including once after the vehicle entered Monroe County when it reportedly traveled halfway into the westbound lane.

Allor then initiated a traffic stop on State Road 45 in Stanford.

According to the affidavit, Wisniewski initially denied consuming alcohol. Allor reported smelling an alcoholic beverage coming from the vehicle and subsequently administered standardized field sobriety tests, during which he observed multiple indicators of impairment.

Wisniewski agreed to a portable breath test at the scene, which registered .134, according to the affidavit. He was then transported to the Greene County Sheriff's Office, where additional sobriety testing was conducted.

A chemical breath test administered at the sheriff's office registered .128 grams of alcohol per 210 liters of breath, according to the affidavit.

Wisniewski is scheduled for an initial hearing Oct. 5.
