A Greene County man is scheduled to appear in Greene Superior Court on July 27 for an initial hearing on four operating while intoxicated charges, including a Level 6 felony alleging he endangered three children who were passengers in his vehicle while driving under the influence.

Lane Allan Smith, 33, is charged with Level 6 felony operating a vehicle while intoxicated endangering a person younger than 18, Class A misdemeanor operating a vehicle while intoxicated endangering a person, Class C misdemeanor operating a vehicle while intoxicated and Class C misdemeanor operating a vehicle with a Schedule I, II, III, or IV controlled substance, or its metabolite, in his blood.

According to a probable cause affidavit, Worthington Police Officer Terrance Cano responded around 6:15 p.m. July 15 after Greene County dispatch broadcast a report of a green minivan driving erratically on State Road 67. The caller also reported occupants were hanging out of the vehicle and said they could smell marijuana as it drove by.

Cano located a vehicle matching the description at the Marathon gas station in Worthington and began following it after it left the business. Police allege the vehicle reached 35 mph in a posted 25 mph zone before a traffic stop was initiated on Terre Haute Road.

As Cano approached the Chrysler Town & Country, he reported smelling the odor of marijuana coming from the vehicle. Court documents state Smith and a female passenger both admitted they had smoked marijuana within the previous one to two hours while their three children — ages 13, 11 and 6 — were playing in a river near Spencer.

According to the affidavit, Smith later told the officer he and his wife had smoked "a hot pack" before driving.

Smith agreed to perform standardized field sobriety tests. The affidavit states he passed the horizontal and vertical gaze nystagmus tests but showed three clues of impairment on both the walk-and-turn and one-leg stand tests.

Investigators obtained a search warrant for a blood draw, which was performed at Greene County General Hospital before Smith was transported to the Greene County Jail.
