A Jasonville driver, with a suspended driver’s license, attracted the attention of a JPD officer when she stopped at a convenience store. She ended up in jail facing drug charges.

Abigayle Rae Figg, 19, Jasonville, was arrested by Officer Skylar Scott of the Jasonville Police Department last Thursday, August 12.

Figg was the driver of a silver 2017 Ford Explorer that was westbound on West Main Street in Jasonville then turned into the parking lot of Casey’s General Store, then parked at a gas pump last Thursday.

Officer Scott was at the store and he recognized the driver and thought her license was suspended. A records check revealed he was correct – license suspended, and the license plate on the Explorer belonged on a red 2003 Ford Focus.

Figg and a passenger exited the vehicle, went into the store, then returned to the vehicle with Figg again getting behind the wheel. Figg then pulled the vehicle into a parking spot next to the building and the officer initiated a traffic stop by activating the red and blue lights on his patrol vehicle.

Officer Scott reported that when Figg got out of her vehicle and started walking toward the building again, he told her to return to her vehicle but she refused and kept walking. He said he told her several times but she continued to refuse so he grabbed an arm but she attempted to pull away. She was placed on the ground in a grassy area then handcuffed. When asked about illegal items, she allegedly indicated there were illegal items in the vehicle.

During a pat down, Figg was found to be in possession of a smoking device with burnt residue and a baggie containing a white crystal-like substance that field-tested positive as methamphetamine.

A search warrant was issued for the vehicle and Officer Scott reported that during a search, he found green plant material that field-tested positive as marijuana along with several items of paraphernalia.

Figg was booked into the Greene County Jail at 6:12 p.m. where she was held without bond pending court appearance.

Yesterday afternoon, August 17, when she appeared in Greene Superior Court via two-way video between the jail and the courtroom, she was formally charged with:

• Possession of methamphetamine, a Level 6 felony,

• Resisting law enforcement – knowingly or intentionally forcibly resists, a Class A misdemeanor,

• Possession of marijuana, a Class B misdemeanor, and

• Possession of paraphernalia, a Class C misdemeanor.

During the hearing, the court was advised a plea agreement was in the works and Greene County Community Corrections was asked to evaluate Figg for work release.

A change of plea and sentencing hearing is set for tomorrow morning, August 19.

Update below, continuing the story, on Friday, August 20……

Court records show on Wednesday, August 18, the day after Figg’s initial hearing, the evaluation was filed by Greene County Community Corrections.

During the change of plea hearing yesterday morning, Thursday, August 19, via two-way video conference between the jail and the courtroom, Figg was not represented by an attorney but a verbal plea agreement was approved by the court and Figg pleaded guilty to Count 1, possession of methamphetamine, a Level 6 felony.

The other three counts were dismissed as was a separate pending case involving possession of marijuana, a Class B misdemeanor.

Figg was sentenced to one year and 180 days, with one year and 90 days suspended, leaving her 90 days to serve. She was given credit for seven days already served and her sentence will be served on work release as long as she remains eligible.
