Teen arrested for disregarding a no-trespassing order
A Solsberry teen, who currently lives in Ellettsville, was arrested yesterday afternoon by a GCSD deputy after deputies responded to the second incident involving the teen in the same day and found him beating on a window trying to get into a house.
Joshua Dylan Wilbur, 18, Solsberry, was arrested by Deputy Harvey Holt of the Greene County Sheriff's Department yesterday afternoon, Tuesday, October 25.
At 1:49 PM yesterday, a woman called the sheriff's department and said Joshua Wilbur was back at her residence. This was the second incident of the day involving Wilbur who had previously been trespassed from the property.
Deputy Holt responded to the property on Washboard Road and found Wilbur standing on the front porch beating on the front window of the house trying to get the woman to let him in.
In a probable cause affidavit prepared by Deputy Holt, the investigating officer, he explained that he had been at the residence earlier in the day along with Deputy James Carpenter about Wilbur trespassing and trying to get into the house. Deputy Holt said Wilbur had previously been incarcerated in a juvenile detention facility for the past two years then was released in June and Deputy Carpenter determined his residence was in Ellettsville because he was placed there to live with his grandfather.
During that earlier incident, Deputy Carpenter advised Wilbur that he was being trespassed from the property on Washboard Road. Wilbur did not sign a form but he was advised of the order verbally given to him around 11:16 AM with the verbal order being video recorded by body camera. Wilbur allegedly acknowledged at that time that he was trespassed and that he would be arrested if he returned to that address. Wilbur was then escorted off the property by Deputy Holt.
So when Wilbur returned to the property again and then Deputy Holt arrived, Wilbur noticed Deputy Holt walking up to him and then started yelling at his mother for help and that he didn't want to go to jail.
Wilbur was placed under arrest for trespassing and handcuffed while saying his mother was letting him inside.
Wilbur was booked into the Greene County Jail at 2:36 PM with bond set at $1000 surety with 10% cash allowed.
A criminal case was filed against Wilbur this morning in Greene Superior Court. The date of his initial hearing is not yet known but he is facing a charge of criminal trespassing, a Class A misdemeanor.
