Suspect accused of spitting in face of deputy

A suspect who was arrested early last Sunday is accused of spitting in the face of a deputy, which is a felony, and he’s facing numerous other charges too.

Vincent Allan Graves, 28, Camby, was arrested by Deputy Michael Stanley of the Greene County Sheriff's Department early Sunday, June 19.

Deputy Stanley was dispatched at 12:45 AM to a location on West County Road 50 North when a man called the sheriff's department and said he had been punched in the face by Vincent Graves during an argument but Graves had left driving a white Ford F-350 with California license plates.

GCSD Deputy Kelly Hutchins, Jasonville Police Officer Dustin Cain and Linton Police Officers JR Blazier, Janzen Franklin and Alan Jackson were looking for the suspect vehicle and conducted a traffic stop at the intersection of 5th St NW and State Road 54 in Linton. Due to the nature of the report by the 911 caller, Graves was asked to exit the vehicle. When Deputy Stanley arrived on scene, Graves was out of the vehicle and had already been detained with hands behind his back.

Graves allegedly said the argument was about the other man's idea of where he wanted to be in life and his feelings toward Graves and the man had grabbed Graves by the shoulders and told him not to talk when he was talking. He said he couldn't believe the man thought he was a threat but the man told him that if he came after him, he was going to pin Graves to the ground.

Officer Blazier reported Graves ran through a stop sign at Price Road and State Road 54 and when he activated his red and blue lights, Graves hit the curb before coming to a stop. He also reported he could smell the odor of alcohol coming from Graves.

Graves refused to take standardized field sobriety tests and refused a portable breathalyzer test.

Graves was transported by Deputy Stanley to the Greene County Jail on suspicion of operating a vehicle while intoxicated based off the 911 call, and on his erratic behavior and body movements, the odor of alcohol, the way he was speaking and his bloodshot eyes.

A search warrant was approved to get a blood sample to determine his blood alcohol content but Graves said he would not allow the officers to take his fluids. Graves became irate and refused to cooperate with jail staff or officers and he resisted EMS staff trying to get a blood draw. During a struggle, Graves allegedly spit on the face of Deputy Stanley.

After a blood draw was obtained, Graves calmed down and cooperated with jail staff. Test results are pending.

Graves was booked in at 6:05 AM with bond set at 11,000 surety with 10% cash allowed. He has since posted $1100 and been released.

Graves is scheduled to be in Greene Superior Court for his initial hearing on June 27 to face charges of:

  • Battery by bodily waste to a law enforcement officer, a Level 6 felony,

  • Operating a vehicle while intoxicated endangering a person, a Class A misdemeanor,

  • Operating a vehicle while intoxicated, a Class C misdemeanor,

  • Two counts of resisting law enforcement, knowingly or intentionally forcibly resisting, a Class A misdemeanor,

  • Refusal to aid an officer, a Class B misdemeanor, and

  • Disorderly conduct, engaging in fighting or tumultuous conduct, a Class B misdemeanor.
