One just arrested, one already on probation in shoplifting case
A couple, accused of stealing numerous items from a Bloomfield store last December, were caught with the goods ranging from shampoo and deodorant to a USB charger. She’s already been convicted of theft and is on probation. He just landed in the Greene County Jail and is facing a felony theft charge.
Dustin Lee Gillihan, 36, Springville, was arrested early today, Monday, November 5, on a warrant that was issued last January following an investigation by Bloomfield Town Marshal Kenneth Tharp.
In mid-December of 2017, Tharp responded to the CVS store in Bloomfield after a caller reported Gillihan and Kayla Marie Freeman, now 27, had stolen several items, left the store then got into a car and left the lot. The caller was able to provide a license plate number.
Tharp located the vehicle on US 231 south of the shopping area and conducted a traffic stop. Gillihan and Freeman were in the back seat and when Tharp explained the reason for the stop, one of the women turned to Gillihan and Freeman and told them if they had stolen something, they’d better not lie to the officer.
Tharp reported he asked Gillihan and Freeman to exit the vehicle and when they did, a light bulb fell out from under Gillihan’s shirt and landed between his feet. Tharp reached down, picked it up, then detained both of them for questioning at the Greene County Sheriff’s Department.
During an interview with Freeman, she gave permission for Tharp to look inside her purse and he reported finding numerous items he suspected had been stolen, along with a glass smoking device with burnt residue.
During an interview with Gillihan, he allegedly said they went into the pharmacy to fill a prescription and were browsing while waiting. When Freeman started pointing out things they needed, he allegedly said they began stealing them.
According to Tharp, Gillihan admitted they stole pantyhose, Tide sticks, a USB charger, shampoo, body wash, deodorant, Crest White Strips and a Square internet debit card reader.
The two were not arrested at that time but were advised to expect criminal charges. They were both told they were no longer allowed in the CVS store.
In January, criminal cases were filed against both individuals.
Freeman was summoned to appear in Greene Superior Court for an initial hearing in February, and she did. She was charged with theft, a Class A misdemeanor, and possession of paraphernalia, a Class C misdemeanor.
When she didn’t show up for a hearing in August, a warrant was issued. After she was arrested in September, she entered into a negotiated plea agreement and in late September, she was convicted of theft. She was sentenced to one year in the county jail, given credit for 12 days served and the remainder of the sentence was suspended. She is currently on probation.
In Gillihan’s case, a warrant was issued for his arrest in January and it’s been outstanding since then. Other warrants are currently out for him in Monroe County, one in a case involving possession of methamphetamine, and another in a case involving felony theft.
Tharp said Gillihan’s criminal history showed he has two prior convictions for theft, both in Monroe County, one in 2015 and one in 2013.
Gillihan’s bond is set at $5,000 surety with ten percent cash allowed. He is scheduled to be in court on Wednesday for his initial hearing on two counts, theft with a prior conviction for theft, a Level 6 felony, and theft, a Class A misdemeanor.
