Lyons man accused of not showing up to serve sentence in the county jail

A Lyons man is now facing a felony charge for allegedly failing to show up to serve a short sentence on a misdemeanor conviction.

David Joseph Sizemore, 56, Lyons, was arrested last Thursday, July 8, by Lyons Town Marshal C. Royce Honeycutt, following an investigation by Greene County Sheriff’s Det. Shawn Cullison.

According to Det. Cullison, on Thursday, July 1, Sizemore was in Greene Superior Court to plead guilty to possession of marijuana. It’s a misdemeanor and he was sentenced to 14 days in the county jail. He was ordered to start serving his sentence on Tuesday, July 6 and was supposed to report to the Greene County Jail by 5 p.m.

Det. Cullison said Sizemore did not show up on July 6 and by early last Thursday, July 8, he still had not reported to the jail.

Sizemore was then taken into custody by Marshal Honeycutt and booked into jail at 6:35 p.m.

A new criminal case was filed against Sizemore. He retained an attorney to represent him and the defense waived his initial hearing.

Sizemore has been charged with failure to return to lawful detention, a Level 6 felony.
