A Lyons driver seemed to have some trouble negotiating a turn. A deputy noticed and made the stop. A test showed the driver had a blood alcohol concentration of .210.

Andrew James Kuchis, 28, Lyons, was arrested by Deputy Jordan Allor of the Greene County Sheriff’s Department on Sunday, February 28. Bond was set at $4,500 surety with ten percent cash allowed. He posted $450 and was released on Monday, March 1.

Around 7 p.m. on Sunday, February 28, Deputy Allor was stopped on State Road 54 near WalMart on the east edge of Linton at the stoplight at County Road 1000 West. He was westbound, waiting for eastbound traffic to pass before turning onto the county road. While waiting, he saw a gray 2007 Saturn Ion turn south on CR 1000 West but in making the turn, it traveled into the opposing lane and almost left the road on the east side of the road. The Saturn then accelerated to a high rate of speed.

Deputy Allor initiated a traffic stop. Kuchis was the driver who said he was just trying to get home. Officer Allor noticed the odor of marijuana coming from the vehicle and the odor of alcohol coming from Kuchi plus Kuchi showed signs of impairment and there was an open Budweiser in the cup holder.

When Kuchi got out of his vehicle, he was unsteady and staggered. Kuchi failed standard field sobriety testing on the scene and was transported to the Linton Police Department where he failed again. Kuchi agreed to take a certified chemical test and results showed he had a blood alcohol concentration of .210. The legal limit is .08. Kuchi was also found to be in possession of marijuana.

Kuchi was booked into the Greene County Jail at 9:18 p.m.

Charges were filed earlier today against Kuchi in Greene Superior Court and his initial hearing is scheduled for March 15.

Kuchi is facing charges of:

• Operating a vehicle while intoxicated endangering a person, a Class A misdemeanor,

• Operating a vehicle while intoxicated, a Class C misdemeanor,

• Operating a vehicle with an alcohol concentration equivalent to .15 or more, a Class A misdemeanor, and

• Possession of marijuana, a Class B misdemeanor.
