Linton man has three criminal cases pending against him

A Linton man who was arrested Tuesday has three criminal cases pending against him, all involving incidents that occurred in Jasonville.

Jonathon D. Smith

Jonathon Dewayne Smith, 32, Linton, was arrested on Tuesday, August 18, on a warrant that was issued in one of at least three cases pending against him.

Smith was arrested in early July in Jasonville by Officer Andrew Duguay of the Jasonville Police Department for allegedly driving while intoxicated. He posted $400 and was released on bond. When he appeared in court, he was charged with operating a vehicle while intoxicated, a Class C misdemeanor, and refusal to aid an officer, a Class B misdemeanor. That case is still pending. The day before Smith’s latest arrest, two more criminal cases were filed against him the day before he was taken into custody.

One of those cases stems from an investigation by Officer Dustin Cain of the Jasonville Police Department into an incident in Jasonville on Thursday, August 6. Officer Cain and JPD Officer Skylar Scott responded to a residence in Jasonville when a woman called 911 and said Smith was trying to break in and had threatened to kill her.

When the officers arrived, the woman explained Smith had been at the back door trying to get in screaming, “I’m going to kill you.” Then as she called police, he punched the glass out of a living room window. When he saw the woman was making a call, he wandered off. She said she had been married to Smith since June and they had been living together, he had been drinking that day and was walking around outside, then got mad and started threatening her so she locked the doors of the house.

The officers found Smith outside behind a garage. He said there had been no physical altercation but Officer Cain said his hand was bleeding.

On Monday, August 17, when a criminal was filed against Smith for the above incident, a warrant was issued for his arrest.

The same day that case was filed, another criminal case was filed against him that stems from another incident that occurred on Tuesday, August 11. On that day, Sgt. Brian Pilant of the Jasonville Police Department responded to the same residence for a domestic. When he arrived, the same woman told him Smith had been drinking and got mad when she wouldn’t give him more money for alcohol. She said he picked up his backpack and walked out the door. She thought he was leaving so she locked the door. Later when he returned and could not get in, he busted out the window on a door, then walked around the house and climbed in the broken-out window.

A physical altercation then occurred and Smith allegedly grabbed the woman’s phone out of her hands while she was trying to call police, and picked the woman up and threw her down with force. Sgt. Pilant noted the woman had injuries to her neck, head and arm.

In this case, Smith is facing preliminary charges of domestic battery, a Class A misdemeanor, and interference with the reporting of a crime, a Class A misdemeanor.

After his arrest, Smith posted $400 and was released.

Now he has one initial hearing set for Monday, August 31, and another one on Thursday, September 10.
