A 22-year-old Linton man has been arrested twice in less than a month. In both cases, officers reported combative or aggressive behavior toward law enforcement that included flailing arms, kicking, screaming and mocking a deputy as she read him his Miranda rights.

Jeremiah Roby’s first arrest, on misdemeanor charges, was on Thursday, May 31. His bond was set at $1,000 surety with ten percent allowed so he bonded out by posting $100 cash.

His second arrest was yesterday, Wednesday, June 20, with bond set at $2,000 surety with ten percent allowed. This time, he’s being charged with a felony.

The first arrest, by Greene County Sheriff’s Deputy Heather Wood, came about during a traffic stop in the Linton area, initiated after Wood and GCSD Sgt. Bobby Pierce observed a car roll through a stop sign, make a left turn without a signal, then turn completely around in the middle of the road and head in the opposite direction.

Roby was a passenger in the car. The driver, who was issued a citation for driving while suspended, said Roby had been drinking and she had gone to pick him up and give him a ride home.

Deputy Wood reported she also said she and Roby had been arguing during the evening due to Roby’s behavior and level of intoxication. According to Wood, Roby was arguing with the woman and then with officers during the stop.

When Officer Andrew Duguay and K9 Blitz from the Jasonville Police Department arrived to assist, Blitz gave an alert for the presence of a controlled substance in the car.

With the driver and Roby outside the vehicle, a substance was located then sent to a lab for analysis. Roby allegedly said anything found in the car belonged to him.

Before placing Roby in the back of a patrol vehicle, Deputy Wood began to read him his Miranda rights.

Wood reported that as she was reading them, he was yelling loudly and mocking her, and on the way to jail, he was screaming and kicking.

During his initial hearing in Greene Superior Court, he was charged with:

• Possession of marijuana, a Class B misdemeanor,
• Possession of paraphernalia, a Class C misdemeanor, and
• Disorderly conduct, a Class B misdemeanor.

In the second case, Linton Police Officer John Agan was on patrol around 1 a.m. Wednesday, June 20, when he saw a vehicle traveling at a high rate of speed northbound on 9th Street NE in Linton.

The officer said the car disregarded a stop sign, then almost hit a pedestrian. He hit the lights but the car didn’t stop. He hit the siren. The car didn’t stop, disregarded another stop sign then entered the parking lot of Musselman Apartments, made a quick turn and came to a stop in an alley. Roby was the driver.

According to Officer Agan, Roby got out of the car and headed toward the patrol car flailing his arms in the air and using a loud voice. Roby was advised to get back in his car but he did not. When the officer got out of his vehicle, Roby allegedly lunged at him – then was placed in restraints.

LPD Officers Nick Yingling and Orry Phipps arrived to assist and Phipps noticed a black digital scale lying between the car and a wooden fence. Then he saw a purple bag lying on the other side of the fence. The owners of that residence opened the fence for the officer to retrieve the bag, reported to contain items of paraphernalia and a substance that field tested positive as marijuana.

Roby was transported to the police department but was allegedly unable to perform standard field sobriety tests. He was uncooperative during an interview then transported to jail.

The preliminary charges filed against Roby on Thursday include:

• Criminal recklessness committed with a deadly weapon, a Level 6 felony,
• Possession of paraphernalia, a Class C misdemeanor,
• Possession of marijuana, a Class B misdemeanor, and
• Refusal to aid an officer, a Class B misdemeanor.
