A Linton man arrested last Sunday night is facing drug charges and one count of false informing for allegedly giving a fake name to an LPD officer. But he was also wanted on four warrants issued out of Vigo County where he has a long list of criminal cases pending against him.

Westly Eugene Noe, 41, Linton, was arrested by Officer Alan Jackson of the Linton Police Department last Sunday night, September 19.

LPD Dispatch got a call around 8 p.m. last Sunday from the Dollar General store on A Street NW in Linton about two individuals they wanted to be trespassed from the property. Officer Jackson was dispatched.

Once at the store, a staff member provided video from the store’s security cameras that showed a woman coming into the store and putting items in a backpack then leaving. The staff member asked for the woman and her significant other to be trespassed from the store. The staff member said they thought they knew where the two lived because of having to retrieve the store’s shopping carts from their residence in the past.

When Officer Jackson arrived at the location on 8th Street NW, he talked to a man on a bicycle in the driveway who identified himself as “Eric Livingston.” Officer Jackson would later determine that was not the man’s name. When the officer showed the man a photo of the woman he was trying to locate from the store, the man said he didn’t recognize her. But when the woman stepped outside the residence, she matched the description of the woman Officer Jackson was looking for.

Both the woman and “Eric Livingston” signed the trespassing form but as Officer Jackson was interacting with them, he realized he had been involved with them on a past call and that the man had given him the same fake name in the past.

It took a while but Officer Jackson was able to determine the man’s name was Westly Noe and when dispatch checked, they found Westly had active warrants out for his arrest in Vigo County and that Vigo County would extradite Noe on his warrants.

By the time Officer Jackson got this information, Noe was inside a garage and didn’t want to come out. The two lived in the back part of a garage at the residence. Officer Jackson entered the garage then forced through a door that had been jammed and located Noe in the back part of the garage.

Noe was taken into custody and during a pat-down, a black metal and corn cob smoking device with burnt residue that appeared to be burnt marijuana was found in a pocket. Noe was worried when asked if he had anything else and indicated he had something hidden in his underwear. He allegedly admitted it was a baggie of crystal meth.

Officer Jackson reported Noe wanted to be unhandcuffed in order to retrieve the item but due to Noe lying about his name and the possibility of him trying to run or fight, the handcuffs stayed on. Because Noe kept trying to retrieve the item out of his underwear, Noe was then handcuffed in front to the front passenger seat so he could not reach his waistband during transport to the sheriff’s department.

After they arrived in the sally port at the jail, Noe was unhandcuffed and he retrieved a bag containing a white crystal substance and threw the item on a nearby table. Noe was booked in at 10:11 p.m. He was being held without bond.

In Greene County, he’s facing charges of:

• Possession of methamphetamine, a Level 6 felony,

• Possession of paraphernalia, a Class C misdemeanor, and

• False informing that substantially hinders a law enforcement procedure, a Class A misdemeanor.

Court records show Noe is wanted on four warrants issued out of Vigo County with numerous cases pending against him including:

• One involving conversion, a Class A misdemeanor,

• Another one involving conversion, a Class A misdemeanor, and possession of paraphernalia with a prior conviction, a Class A misdemeanor,

• One involving possession of methamphetamine, a Level 6 felony, possession of a controlled substance, a Class A misdemeanor, and possession of a substance represented to be a controlled substance, a Class C misdemeanor,

• One involving unlawful possession or use of a legend drug, a Level 6 felony, and unlawful possession of a smoking instrument, a Level 6 felony,

• Another one involving conversion, a Class A misdemeanor,

• One involving operating a motor vehicle after forfeiture of license for life, a Level 5 felony, and operating a vehicle while intoxicated endangering a person, a Class A misdemeanor, and possession of paraphernalia, a Class C misdemeanor, and

• Another one involving criminal trespassing a Class A misdemeanor, resisting law enforcement, a Class A misdemeanor, disorderly conduct, a Class B misdemeanor and possession of paraphernalia, a Class C misdemeanor.
