Linton driver arrested early Sunday for OVWI

A Linton driver was arrested early Sunday morning for OVWI after he allegedly admitted he shouldn’t be driving and knew he would not pass a breath test.

Eric Ryan Nagy, 27, Linton, was arrested by Officer Bobby Pierce of the Linton Police Department early Sunday morning, June 27.

Nagy was the driver of a white Ford Fusion that was stopped by Officer Pierce for failure to properly signal a turn around 4:11 a.m. Sunday in the area of North County Road 1300 West and West CR 140 North.

Officer Pierce reported Nagy showed numerous signs of intoxication including slurred speech, poor balance and the odor of an alcoholic beverage. Nagy allegedly admitted he had been drinking, shouldn’t be driving and he said he would fail a breath test.

Nagy reportedly did fail standard field sobriety testing then agreed to take a chemical breath test at the Linton Police Department. Results showed he had a BAC of .18. The legal limit is .08.

Nagy was booked into the Greene County Jail at 6:10 a.m. with bond set at $8,000 surety with ten percent cash allowed. He posted $800 and was released later the same day.

Preliminary charges filed against Nagy in Greene Superior Court include:

  • Operating a vehicle while intoxicated – with a prior conviction within seven years, a Level 6 felony,

  • Operating a vehicle with an alcohol concentration equivalent to .15 or more – with a prior conviction, a Level 6 felony,

  • Operating a vehicle while intoxicated, a Class C misdemeanor, and

  • Operating a vehicle with an alcohol concentration equivalent to .15 or more, a Class A misdemeanor.
